Fake Encounters A view from Mainstream Media

Fact finding report

Kannur,
07- 05 - 2013

Following the news reports about the arrest of 21 Muslim youths under UAPA in Narath (Kannur dt.) by the Kerala police, a team of National Confederation of Human Rights (NCHRO) visited the place yesterday and today, met the relatives of the arrested, people living in the neighbourhood of the place of arrest and police officers with a view to collect the facts regarding. The team members are: NCHRO National Secretary Reny Ayline (Trivandram), Executive Members Prof. A.Marx (Chennai), G.Sugumaran (Puducherry), Kerala state committee member Advocate M.Abdul Shukoor (Malappuram), Writer and Activist K.M.Venugopalan (Kannur) and Journalist Mohammed Shabir (Mangalore).
All the youths arrested are sympathisers of Popular Front of India (PFI), a registered organisation . They are conducting a programme every year known as Healthy People, Healthy Nation in which they impart physical fitness training, yoga, some martial arts as well as religious and moral education to young people. This year also they were conducting the programme in a building owned by one Thanal Trust which is also a registered body under Charitable Trusts Act. This building is situated in a densely populated area in Narath behind the Falah English Medium High School. It is a half-built building without proper doors or the windows and everything that
happens within the four walls of the building is visible to everybody outside. All the youths who took part in the programme were coming from the neighbourhood villages and they used to return to their homes in the nights.
.
According to the eye witnesses of the arrest which includes Mrs P.M.Saleem, Mrs. Abdul Jaffar, M.Abdullah, K.P.Mussam Kutty, all neighbours living around that building, a team of four policemen first entered the building
on April 23 around 12.30 pm. The people around thought that it might be a regular visit of the police who used to come there often in search of sand mafia who are very active in that area. But soon a large battalion of police came there and took all the people in the building with them. The police version of the story goes like this. As per the FIR filed by them (Mayyil P.S. FIR No 276/13), these people were given instructions on
bomb making and training in the use of arms. They were able to seize two country bombs, one sword, and some materials and instruments necessary to make the bombs. Accordingly cases were filed under sections 143, 147,
153(B), R/W 149 IPC, Sec 5(1)(a) r/w 25(1)(a) of Arms Act, Sec 4 & of ES Act and Sec 18 of UAPA) against all the 21 Muslim youths and they were remanded to custody.
But not only the parents and relatives of the accused but also the neighbours mentioned above told us that no such armed training took place there, all the physical exercises and classes were very peaceful. One of
the neighbours M.Abdullah said that he used to send his wife for the religious classes conducted there. The only Hindu living near the building one Suthish s/o Raghavan also said the same. He also denied that any bomb
making or arms trainings were imparted to them. The Jamath member Mussam Kutty and the principal of Falah English Medium School Mr.P.Mustafa also said that the programmes were very peaceful and no such arms training were given to the inmates.
We also met the President of the Narath Grama Panchayat Mr.K.V.Mamy and a ward member Abdul Salam Haji. The former is a member of CPI(M) and the latter that of IUML. They also said that no such arms and bomb making trainings are possible in their panchayat limit. Nothing of that sort happened, they said. The president also attended a training programme conducted by the Thanal trust few weeks back known as =E2=80=98Happy Family in which Dr Ashraff, a psychologist took classes for women. Thanal trust also use to distribute school kits to poor children and conduct programmes to school drop outs. The President also said that there prevailed a political enmity between PFI and IUML because the front was responsible for the defeat of the IUML candidate in the last Panchayat election.
We visited the houses of at least four accused persons and met their near and dear. They all said that all the accused were brought from the Thanal trust building on April 23 to the police station on a promise that they
would be sent back after an enquiry. Only in the evening they came to know through the media that so many serious cases are foisted against them. No such arms and bombs were seized either in the building at the time of arrest or in their houses during searches. Some of their statements:
C.P.Musa, Former teacher , Kottancherry : =E2=80=9CMy son Fahad (27) is a B.Com graduate. He owns a Travel Agency. He is also a franchise holder of Western Union Money Transfer and people living in foreign countries use to send money to their relatives for building houses through him. As a teacher I can say that he is a very good student, he is very pious, use to pray 5 times a day, fast two times a week. He is a sympathiser of PFI. The police searched my house and also my son & travel agency. They found nothing
incriminating. They took only a copy of the Holy Quran and a marriage cd from my son's office. We came to know his arrest through the media.
A.P.Umar, Muzhappillangadi : My son Rickas (22) is studiying M.B.A. He is not a member of any organisation. I came to know his arrest only through the media. Some political opponents must have given false information to
the police. Police came to my house but found nothing.

C.P.Mustafa, Auto Driver, Muzhappillangadi : My son Jamsheed (20) is a student of civil engineering. Two days back I met him in the prison. He said that one investigating officer told him that if he accepted the charge, they would give him 2 lakh rupees in cash and a new house M.Sanfaras, Manager in a private company in Bangalore :
Rshid (22) is a +2 student. Our father is no more. They raided my house and found nothing. My brother had no connection with any organisation. My mother and other family members came to know about his arrest only through the media. Mr. Kalyattu Surendhran, the Station Officer of the Mayyil police station denied the allegations of the relatives of the accused. He said that it was true that arms and bomb making trainings were given to the accused. When we asked him that how such clandestine activities were possible in such a
crowded place and that too in an open building without window doors , he was not able to give a proper reply. When we asked him about what sort of bombs were seized from them, he said that they were giving training to make something like bombsand two of which were seized by them. When we asked about other incriminating materials seized he showed a register in which it was stated that a cd about and a pamphlet on the role of Sangh
Parivar in blast cases were seized . The pamphlet Spoadana Bheekat rathayil Sangaparivarathinte Paghu as written by one Jalarudin Vazhakkad and published by Jamathe Islami. Earlier it was published as a serial in the
magazine Praboadhanam. When we pointed out that these were not banned documents and were available freely in the market, he replied, may be.
We also met the DySP P.Sukumaran and Inspector P.Balakrishnan in the former's office .They told that UAPA was invoked on them not for the bombs seized there, but the mind set of certain Muslims are such that these laws were to be used against them.Kerala is a beautiful country and there is no majority / minority problem here. There is no problem with the Christian minority; however, Muslim minority are not like that said the DySP. We
have arrested them not only for bomb making. We have seized there 172 incriminating documents which necessitated the application of UAPA, said the Inspector. But that list of 172 documents contain only
items like Indian currencies, ID cards, paper cuttings..etc. The DySP also said that he had received a complaint from the local mosque committee that the activities in that building are to be watched. But when we met a Jamath member he denied that any clandestine activities took place in that building which we have already quoted.
Our Observations : 1. The Supreme Court directions given in D.K.Basu case were not followed in these arrests. The police has lied to the court that the parents were informed about the arrests by phone whereas they came to
know about it only through the media.
2. It was not at all possible that any training on the use of arms and bomb making can be imparted to the youths in such a thickly populated and open place and that too in a building without doors or the windows. Such physical and moral training classes were conducted by PFI in the same place at least for the past three years and no complaints were received by the police about any clandestine activities. When the police visited there
once, they didn=E2=80=99t find anything. All the neighbours living around the building also deny such allegations. We also wonder what sort of arms training could have been given to at least 21 people with a single sword and a few wooden sticks. It is ridiculous to say that some freely available pamphlets and compact discs are shown as incriminating materials. Since nobody had seen the police seizing something like bombs in the building, we strongly believe that the bomb story is hoaxed by the police to justify their action and malign the movement.
3. We are much worried about the way in which rumours are spread against the arrested youths by the intelligence through the media. Some sixty lakhs rupees found in the account of one accused is focused as large illegal foreign money involved in this act. Actually he is involved in a travel business and holds a consultancy for admission in self financing engineering and medical colleges. He receives money from migrant labours in
foreign countries to build houses through a friend of him. The police were not able to find anything illegal in that account. Few days back one newspaper has published that the Narath accused were involved in Coimbatore
serial bomb blast case. All the accused are young people and most of them were school going children when Coimbatore incident took place and some of them had not even born at that time. A Kish identity card seized from one of the accused is also projected as related to some anti national activity.
But having a Kish ID is a normal thing used as an intermediary pass to move to UAE for those who have no permanent visa to that country.

4. Except one of them , all other 20 young men arrested were not at all involved in any other pending cases.
5. It is very sad that Kerala police has foisted such false cases against these innocent youths at a time when there is widespread concern expressed throughout the nation on # arrests of innocent Muslim youths. Most of them had been kept in prison for so many years and then released as they were innocents. Not only their prime youthful years were lost in prison, but stigmatized of being dubbed anti nationals because of this arrest, they
are not even able to get good jobs and decent livelihood. Recently, the Supreme Court also has condemned this. The Press Council Chairperson Justice Markandeya Katju had expressed concern about spreading such false
propaganda against innocent Muslim youths in the media. He has also proposed an institution known as.The Court of Last Resort to extend help and save such innocent youths languishing in Indian prisons. It is no one position that those who plant bombs should go unpunished. As the editor of Tehelka magazine Shoma Chaudhri has written, do not make false arrests and breed fresh despair, triggering new cycles of hate and revenge. In the
clever calculations men make about security and State, they underestimate the power of human despair. When you lose faith that a system will play fair by you, it can breed fatal recklessness. It can make you abdicate from
the rules that cement human relations. Despair can turn you from citizen to perpetrator, from the hunted to the hunter. Despair can be a deadly weapon. Even parties like CPI(M) have now raised this issue. Recently the
CPI(M) leader Prakash Karat took a list of 22 Muslims to President Pranab Mukherjee and demanded the Centre to take immediate steps to help such victims of State-led injustice. The demands included fast-track courts;
rehabilitation and compensation for those had been falsely jailed; and a review of the UAPA

Our Demands
1. We strongly believe that all the allegations against these youths are false and the fake case foisted against these innocent youths should be immediately withdrawn and those arrested should be unconditionally
released. Special care should be taken to allow the students to write their examinations.
2. We cannot find any logic to evoke a draconian Act like UAPA in this case. Since nationwide concern is expressed against this Act, we demand that UAPA should be repealed immediately.
3. The case against these 21 youths was deliberately foisted with a view to harassing them and spoiling the name of PFI. With spreading rumours against these innocent youths we find them stigmatized as anti nationals, which in turn will spoil their future. It is alleged that during interrogation, the police had chosen the poorest among them and offered two lakh rupees and a new house in exchange for accepting the charges and becoming an
approver. We demand a judicial enquiry in this arrest by a sitting High Court Judge. The police officers responsible for foisting this case should be punished and the innocent youths should be given compensation.
4. Kerala is the state with highest literacy rate and the political, civil rights and trade union consciousness among the people are larger when compared to other states. We humbly issue a call to the political parties,
writers and other intelligentsia to condemn the indiscriminate use of draconian laws such as UAPA against innocent youths

5. From our conversation with the higher police officials we understand that they are biased against the Muslim minority in the state. We demand that sensitization programmes should be conducted for the revenue and
police personnel on problems faced by minorities, dalits and adivasis. Also, sufficient number of officials from minority communities is to be posted in areas in which the above sections of population are in large

numbers .

Unending Spiral of Violence: Darbha

PEOPLE’S UNION FOR DEMOCRATIC RIGHTS
PRESS RELEASE
31st May 2013

The People’s Union for Democratic Rights (PUDR) notes with concern the sad loss of 30 lives in the Maoist attack on the “Parivartan Rally” of Congress Party on 25 May 2013. This is the latest in the series of killings, big and small, in the ongoing undeclared war that the Indian government is waging against our own people. Many of the victims of this war are poor adivasis killed in operations by the security forces, that the government assiduously attempts to hide from the public at large. But, as in the present instance, ruling party functionaries, security forces personnel and Maoist cadres have also lost their lives.
Since 2005, the PUDR and a number of civil liberties organizations have been consistently alerting the public to this escalating war against the poorest of our citizens. Between May 2012 and May 2013 there has been a six to eight times increase in the number of security forces operations being carried out in the Bastar division of Chhattisgarh. In every district no less than 10-15 operations were already being carried out each month. These are being conducted away from the prying eye of the media and civil liberties activists and civilian access to these areas is severely curtailed. On 17 May, ten days before the attack on Congress leaders, nine persons including three children were killed by the security forces in the village of Ehadesmeta.
While PUDR sees the killing of two people who were taken into custody in this instance as an act that cannot be justified and against the rules of war, there is a need to speak out about the role of parties such as Congress and BJP in launching Salwa Judum, which was designed to terrorise the adivasis of Bastar. Congress leaders like Mahendra Karma, the BJP led Chhattisgarh government and the UPA government patronized this murderous enterprise until it was declared illegal by the Supreme Court of India. While Salwa Judum may have formally ended, the elements which comprised the SJ including its leaders and handlers in the security establishment were either incorporated in the ongoing operations as regular forces or some of them chose to switch from being ‘hunters’ to ‘running with the hares’ with impending state assembly elections due in November. In any case, every attempt to prosecute those guilty of the heinous crimes had been frustrated by the governments in power. So the carnage that took place on 26 May was something, unfortunately, waiting to happen.
The governments have plainly connected the continuation of the ongoing war with the prospects of growth in national income. None other than Indian Prime Minister Manmohan Singh declared Maoists to be the single biggest internal security threat in 2006. Speaking to IPS probationers on 24th December 2010, he also explained the reason for the war: “Naxalism today afflicts the Central India parts where the bulk of India’s mineral wealth lies and if we don’t control Naxalism we have to say goodbye to our country’s ambitions to sustain growth rate of 10-11 per cent per annum.”
All doubts were laid to rest when government actions confirmed the verbal declarations. In Saranda forest of Jharkhand, once the Maoists were forced to pull back, the Forest Advisory Committee of the Ministry of Environment and Forests began clearing proposals of mining corporations to take over forests for non-forest use. It led Minister for Rural Development, Jairam Ramesh, to complain on 7 February 2013 that “I have been at great pains to counter Maoist propaganda that the Saranda Development Project is a ploy to benefit private mining interests. This Forest Advisory Committee decision is a huge setback and very retrograde” (8 February 2013, Indian Express, Delhi). The Union Tribal Affairs Minister Kishore Chandra Deo complained to Hindustan Times (17 May 2013) that “my permission [is] not required nor my opinion is sought in matters relating to tribals. My voice goes unheard”.
On the other hand, legislations and constitutional provisions meant to safeguard tribals are being thrown to the winds. The fate of the Forest Rights Act (FRA), the showpiece legislation of UPA-I, ostensibly promulgated for empowering forest dwellers, is a case in point. Quite apart from its poor implementation, the core issue of Gram Sabha’s “consent” for non-tribal use of tribal land has been diluted not just in the name of “linear projects”, but in the Congress-ruled Andhra Pradesh the government has concluded that under the FRA, Gram Sabha consent is required only to permit mining of minor minerals whereas major minerals such as bauxite and iron ore etc are outside their jurisdiction. Supreme Court’s latest order on Niyamgiri Hills narrows down the jurisdiction of Gram Sabhas by reducing and restricting the definition of impacted area to a radius of ten kilometers, when it is a known fact that livelihood and lives are affected across a much larger area.
It is this continued attack on lives and livelihood of people, threat of displacement from forest areas, dilution of FRA, PESA and complete indifference to Sixth Schedule compounded by the increasing restrictions on public protests, arbitrary laws to prosecute those who oppose their dispossession and bans on political opinion that is responsible for the civil unrest that pervades our society. It is this government that places the requirements of Foreign Direct Investment above the needs of our own people, and which attempts to ram down this “development model” with the barrel of a gun, that is at fault.
As the war is being scaled up it is also turning ugly. PUDR, therefore, urges all people to bring pressure on the ruling parties at the Centre and the nine state governments currently carrying out this war, to de-escalate the militarisation of this region and show a commitment towards dialogue. We hope that the deaths of 30 persons in the present instance and of hundreds of people in the past eight years are sufficient reason for people to recognize the absurdity of this war.
In the meantime, we ask the Government of India to shed its policy of deniability and accept that it is engaged in an internal war. And we ask both sides to abide by the rules that govern war by declaring its commitment to common article 3 of Geneva Convention and Protocol II, which applies to non-international armed conflict.

Condemnation of unprecedented detention of CDRO team by Jharkhand police

May 29, 2013
Sanhati.com
We strongly condemn the absolutely arbitrary and unprecedented action of the Jharkhand police administration in detaining eight members of a CDRO (Coordination of Democratic Rights Organizations) fact-finding team while they were addressing a press conference in Ranchi. The team had just returned from a fact-finding mission to Chatra, where ten members of the CPI(Maoist) had been supposedly killed in a long gun battle with the TPC, a splinter group actively supported by the state government, in March 2013. However, at that time, there were local media reports that the CPI(Maoist) members had been poisoned and then shot to death in a false encounter. The fact-finding team, consisting of members from PUCL Jharkhand, APDR West Bengal and PUDR Delhi, had gone to investigate the veracity of these reports and the circumstances behind the incident. They were in the process of addressing the press and releasing their report while officials of the Jharkhand police, accompanied by a large number of policemen came and picked them up without providing any explanation.
The audaciousness of the act, committed in presence of the assembled press, clearly shows the scant respect for democracy and democratic procedures which the Jharkhand police has. The members of the team, including a woman, were detained in the Kotwali police station for a long time till they were released late in the evening. The police maintained that they had just been picked up for finding information, although it is unclear what information the former were seeking which could only be obtained by picking them up from the venue of a press conference using a posse of armed policemen. This is clearly a tactic of intimidation by the Jharkhand government to dissuade future fact-finding teams from visiting sites of incidents where the state government, or groups supported by the state government, are complicit in criminal activities. However, it is incredible that such a thing can happen in broad daylight and in open view of the public and press. We unequivocally condemn this blatant attack on the activities of democratic rights organizations and the attempt to muzzle them in order to hide the criminal complicity of the state government in encounter killings and other illegal activities.

Release of PUDR report

People’s Union for Democratic Rights

23 May 2013
Press Release

Release of PUDR report ‘Driving Force: Labour Struggles and Violation of Rights in Maruti Suzuki India Limited’(May 2013) at Press Conference in Chandigarh

On 18 July 2012 a violent incident occurred at the Manesar unit of Maruti Suzuki India Limited (MSIL), in which an HR manager died and some other managers as well as workers were injured.  Following reports of severe harassment of Maruti workers and their families in late July 2012, Peoples Union for Democratic Rights (PUDR) began a fact-finding investigation into the incident, its context and implications.  We are releasing our findings today in the form of a report ‘Driving Force: Labour Struggles and Violation of Rights in Maruti Suzuki India Limited’ (PUDR, May, 2013). This report follows PUDR’s two previous reports Hard Drive (2001) and Freewheelin’ Capital (2007) which recorded crucial moments of the labour struggle at Maruti. In the course of our fact finding, we have met or spoken to the workers (contract, permanent and terminated), the union leaders, their lawyer as well as officials from the labour department, Gurgaon, and different police officials. All attempts to meet the management turned out to be futile because it did not give us appointment for a meeting despite our persistent efforts.

PUDR’s findings, recorded in the report are as follows:

(1)               The events of 18 July 2012 at Maruti's Manesar unit are still heavily shrouded in ambiguity and the real culprits can be identified only if a thorough investigation is done by an independent agency which is not influenced by the management. The Haryana police have been consistently acting in a partisan manner favouring the management since the incident, and therefore cannot be entrusted with this task. The lack of an independent investigation into the incident has been amounting to a grave miscarriage of justice.
(2)               In an absolute disregard for the rule of law, the entire blame for the incident was put on the workers not just by the management, but also the police and administration, long before the investigation was over. The nexus between the police and the management got exposed most starkly after the 18 July incident. The close correspondence between the FIR lodged by the police containing between 500 and 600 ‘unnamed accused’ and the termination of 546 workers by the company allegedly for being responsible for the violence on 18 July, cannot be a coincidence. It shows exactly how closely the police are protecting the company’s interests.
(3)               This presumption of guilt governed the manner in which the police acted after the incident. The police arbitrarily arrested a large number of workers not through an investigation, but on the basis of lists provided by the management targeting the workers who were vocal, articulate and active in the union, subjected the arrested workers to brutal torture, violated the constitutional safeguards regarding detention and arrests and harassed the family members of the workers. Not only this it has been continuing to intimidate, target and attack the on going struggle of the terminated and other workers in order to silence and criminalise their legitimate protest (See Chapter Four). The scale of police action against workers seems to be aimed to act as a deterrent for any agitation in future – not only by these workers but also other workers in the Manesar and Gurgaon industrial area. Most recently on 18 May 2013, the Haryana police imposed Section 144 CrPC in Kaithal and arrested around 150 workers peacefully protesting there since 24 March demanding release of arrested workers and reinstatement of terminated workers.
(4)               Another example of the police colluding with the management is that it has in the course of investigating the incident completely ignored the discrepancies in the management’s account, the fact that the workers were also injured, the presence of bouncers in the premises, or the fact that Awanish Dev, was always considered by the workers to be sympathetic to them.  In fact it is the workers’ who have been demanding an independent investigation into the incident, a demand which has been ignored by the state and the central government.
(5)               We wish to assert that an investigation and trial based on preconceived notions and not on the basis of scientifically gathered evidence could mean that those responsible for Awanish Dev’s death will go scot free and innocents will be penalised. A close look at the charge sheet filed by the police and denial of bail to the arrested workers shows that the case is moving in this very direction. This would amount to a travesty of law and denial of justice not only to the workers, but also to Awanish Dev.
(6)               The incident should be seen in the context of the long chain of events that preceded it. It can be understood in the light of the continuous tension and conflict in the unit between the management and the workers as well as their persistent struggle of workers of the Manesar unit to register a union and draw attention to their inhuman working conditions.
(7)               In September 2011, the Maruti management at the Manesar unit imposed a condition that the workers could enter the plant for work only after signing a 'good conduct' undertaking. The ‘good conduct’ undertaking effectively takes away the right of the workers to go on a legal strike, a right guaranteed by the Industrial Disputes Act (25T, 25U read with the Fifth Schedule); this also amounts to unfair labour practice as per Section 8, Fifth Schedule, IDA. (See Chapter Three)
(8)               Like all other corporates, the main driving factor in Maruti is reducing production costs, maximising profits and competing against other companies. Maruti's expenditure on workers is among the lowest in automobile companies. Moreover the company adopts various measures to extract maximum work from itsworkers. At Maruti therefore, the production capability and targets are set considerably higher than the installed capacity, i.e., production capability of the company is 1.55 million units per annum even though installed capacity is 1.26 units per annum (Annual Report, Maruti Suzuki India Limited, 2011- 12). Workers are made to work non stop like robots for eight and a half hours, with a break of only 30 minutes for lunch and two tea breaks of 7 minutes each. For years, workers have been made to both report for duty 15 minutes before shift-time and also work for 15 minutes extra every day without any overtime payment. Further the policy on leave is very stringent and the leave record is directly linked to the wages which are deducted on account of any leave taken. This contributes to the regime of ceaseless production and drastic increase in work pressure on the Maruti shopfloors.
(9)               The wage deductions on account of leave are made from the incentive-linked part of the wages of Maruti workers, under the Production-Performance-Reward Scheme. A single leave taken by a permanent worker, with permission from the supervisor, could also cost him a loss of Rs. 1200 to Rs. 1500. Both before and after the 18 July 2012 incident, a part of the wages is fixed, and a major component paid as incentive wages linked to production, profit and leave records, which makes the wages fluctuating. Norms of incentive linked wages have been arbitrarily fixed and changed by the management at Maruti's Manesar plant. (See Chapter Two and Three)
(10)           Maruti management especially at Manesar have been resorting to use of temporary and contract labour as a norm, for regular work. In July 2012, according to figures tabulated by the Labour Department, less than 25% of the workers at Manesar were permanent. These workers are paid only for the days they work (i.e., 26 days a month) and considerably less than the permanent workers, for doing the same work. Not only is this a major cost cutting measure but it secures for the company a more vulnerable, disempowered and pliant work-force, less likely to be vocal and demand their rights. The company's announced after the 18 July incident, that it will regularise its workers. This is yet to materialise. (See Chapter Two)
(11)           The Maruti management has also consistently violated the workers’ rights by creating hurdles and actively preventing them from organising themselves. The policy of the Maruti management not to let the workers unionise, is a violation of the Indian Trade Union Act (1926). Since mid-2011, as the workers’ struggle intensified, the management has responded by targeting active workers through suspensions, terminations and registration of false cases against them. Once the union got registered, its members and coordinators have faced similar or worse harassment. All the union leaders and many active members were implicated in the 18 July incident leading to complete breakdown of the union and making the workers vulnerable as they have lost all avenues of negotiation with the management. A large number of active workers were subsequently terminated by the company, as mentioned, because the company arbitrarily held them responsible for the 18 July incident. After forcibly removing the union from the unit, the company is now making a farcical gesture towards dealing with workers’ issues, by setting up a joint worker-management ‘grievance committee’ and compelling the workers to be a part of it. The legally registered union (MSWU) whose members are continuing to take up workers' issues are not being allowed to function inside the unit.
(12)            The Haryana Labour Department has connived with the management in depriving the workers their right to unionise. In August 2011, it rejected the pending application of the workers for registration, citing technical grounds. Effectively, an application for registration filed on 3 June 2011, resulted in actual registration of the union on 1 March 2012, after months of fraught struggle. Moreover the Labour Department does not appear to have ever intervened in support of workers' rights in the labour disputes at Maruti. When the management deducted Maruti Manesar workers' wages on account of the lockout of 2011, by describing it as a strike, or when the management failed to act upon the Charter of Demands of workers in 2012, the Labour Department did not intervene. It has failed to question the management on its use of dubious and unfair labour practices, the 'good conduct undertaking' or the use of contract labour for regular work. (See Chapter Three)
(13)           One of the notable features of the recent labour struggles at Maruti’s Manesar unit has been an unprecedented unity between permanent and contract workers. The labour union has consistently taken up issues pertaining to the contract workers. One of the main demands from the beginning of the struggle has been the regularisation of contract workers. The terminated workers who have regrouped under the MSWU include both permanent and contract workers. Contract workers are also among those who have been held guilty of the violence on 18 July and are now in jail.

What makes the Maruti story extraordinary is certainly not the company and its cars but the extraordinary struggle of its workers that has continued inspite of ruthless repression by the management and the police and failure of the labour department and the judiciary at all levels to provide any justice to them. Above all, the workers have tenaciously fought for their political right to form their own union. The struggle has also concentrated on creating democratic structures within the union, and through these, finding ways of articulating their grievances regarding the highly exploitative labour regime.

PUDR demands that:
1. An independent and unbiased judicial enquiry should be initiated into the events that led to the death of Awanish Dev. The judge nominated should be someone both parties are agreeable to.
2. The police investigation into the 18 July incident carried out by police officers of Haryana should be nullified and a fresh investigation be initiated, by an SIT comprising police drawn from other states.
3. The role of hired bouncers that led to the precipitation of the events at the spot be investigated.
4. The Haryana police officials, responsible for violation of legal guidelines regarding arrest and for custodial torture of arrestees, and harassment of their family members be identified and criminally prosecuted.
5. Re-instatement of all workers should be ensured in the absence of definite evidence of their involvement.
6. Role of the labour department should be investigated and action should be taken against the officials for not fulfilling their obligations related to labour laws.
7. All the workers arrested for the 18 July incident should be immediately granted bail. The trial into the incident should be speedily done and those not guilty should be acquitted.
8. Workers' right to have their independent union be restored at Maruti. The MSWU which is the legally recognised union of the Maruti Manesar unit should be allowed to function inside the plant with immediate effect.
9. All the contract workers both at Manesar and Gurgaon unit be immediately regularised and practice of hiring contract workers for regular work should be stopped.
10. The rights of workers guaranteed in law be enforced at Maruti with immediate effect.
