Eight deaths, 30 attacks, 48 cases of defamation, 14 of sedition—its been grim year for free speech in India.

 Introduction
2015 was a hugely eventful year for free speech in India. There were legal, political and technological developments that set the tone for these issues to be debated all year round. And journalists were at their most vulnerable, with deaths, attacks, threats, sedition and defamation cases against them at an all-time high.

THE YEAR’S  LEADING CHALLENGERS TO MEDIA FREEDOM
We begin by listing those politicians and government organizations who deserve recognition for the challenge they posed to media freedom in this country.
The top ranks go to these four:
  • Chief minister J. Jayalalithaa and the Tamil Nadu government
  • The Government and the Ministry of Information and Broadcasting
  • The Central Board of Film Certification
  • The Chhattisgarh state government

CM Jayalalithaa and the Tamil Nadu Government
When the Chennai floods brought journalists from other parts of the country to Tamil Nadu, they noticed that questions about fixing blame were neither asked by the press in Tamil Nadu, nor answered by officials at press conferences. It was an indicator of the defamation capital that this city has become.
In 2015 the chief minister, her ministers, and her government filed a large number of criminal defamation cases against a range of magazines and individuals, prompting the Supreme Court to take note by the year end. The apex court said that the bulk of defamation cases against political leaders has  been filed in Tamil Nadu, and slammed the state government for granting sanction for prosecution in these cases.
In May the Supreme Court gave omnibus relief to the magazine Nakkeeranin connection with a set of 15 criminal defamation proceedings initiated against it by the chief minister, ministers and senior IAS officers in Tamil Nadu. These 15 complaints cited all its 20 reporters as respondents.
In November, criticism of government in action led the City Public Prosecutor M.L.Jegan to file a criminal defamation case against the weekly magazine Ananda Vikatan for ‘maligning’ the Tamil Nadu Chief Minister because an article had asked what Jayalalithaa had done so far.
In this report’s total count of 48 defamation cases in 2015,  the Tamil Nadu government accounts for 11 of them and for two of the 14 sedition cases filed in the country.  In December 2015 the Telegraph  reported that the Jayalalithaa government has filed a total of 190 defamation cases during it tenure.

The Government of India and the Ministry of Information & Broadcasting
The I& B ministry under the Bharatiya Janata Party government has become an image manager for its leaders and a censor rather than a provider of information. Its brief now is to safeguard the PM’s image. A few days ago, the Hindu reported that the Ministry will also monitor footage showing the I&B Minister and the Minister for I&B State, in what is an unprecedented move.
 In 2015 Sathiyam TV, a Chennai-based Tamil language news and current affairs channel, received  a show cause notice alleging that two of their broadcasts had portrayed Narendra Modi in a poor light. In the course of the year, the government issued an advisory to news channels not to telecast the Nirbhaya documentary and served a legal notice to the BBC for airing the Nirbhaya film 'India's Daughter'. It also focused its energies on preventing information leaks to the media and defended its curbs on journalists.
In the course of the year, three channels were issued show cause notices on why they should not face action for YakubMemon’s execution coverage. Among other actions, the I&B Ministry banned a documentary on beef and issued a notice to a Gujarat channel for 'sullying' the image of the prime minister.
Following the extended resistance of the students of the Film and Television Institute of India to the appointment of a director at the International Film Festival of India later in the year, the Ministry decided to drop the student film section at the festival.

The Central Board of Film Certification
This government body acquired a new head early in the year, Pahlaj Nihalani, who remained in the news all year round. The body he headed censored some 21 films in the course of the year, one of which came in for 218 cuts. The CBFC made the most news at the end of the year for shortening the duration of a James Bond kiss. Consequently, on the first day of 2016 the government announced a 6-member panel to review the functioning of the CBFC.

The Chhattisgarh Government
It  jailed two journalists and presided over the state harassment of journalists in the Bastar region, which led them to hold a protest in Jagdalpur at the end of the year.

These figures  are based on incidents reported in the press and should be treated as conservative estimates. The figures on attacks against journalists collected by the National Crime Records Bureau are not available yet for 2015. The figures for deaths include those cases in which investigations are not complete.

 Jan 4: Attack on G Stephen Babu, Editor of Crime Today at Vinukonda in Guntur district.
 Jan 14 : Tamil writer Perumal Murugan announces his ‘death’ as a writer on his Facebook page, after being hounded by caste-based groups and Hindutva forces in Tiruchengode, Tamil Nadu, for his novel Madhorubhagan
Jan 16: Leela Samson resigns as Chairperson of the Central Board of Film Certification, reportedly over ‘interference, coercion and corruption of panel members and officers of the organisation who are appointed by the ministry.’ Nine members resign a day later in support.
Jan 28: Shirin Dalvi, editor of Mumbai-based newspaper Avadhnama, is arrested for reproducing the cover of Charlie Hebdo magazine.

February
February 2: A police complaint is lodged against the organizers of the comedy group All India Bakchod by the Brahman Ekta Seva Sanstha for alleged abusive language in a roast that was organized in Mumbai on Dec 20, 2014.
February 2: Members of the Kongu Vellalr community abduct and thrash Tamil writer ‘Puliyur’ Murugesan for allegedly portraying the women of their community in a bad light in his compendium of short stories.
February 11: Penguin India agrees to withdraw and pulp all unsold copies of American scholar Wendy Doniger's 'The Hindus: An Alternative History' after a protracted legal battle with Hindutva organization Shiksha Bachao Andolan ends in a settlement.
February 21: Senior Communist leader, rationalist and writer of the popular book ‘Shivajikonhota’, Govind Pansare is shot by two persons on February 16 when out on a morning walk with his wife. He succumbs to his injuries five days later.

 March
March 5: The Indian government imposes a blanket ban on the screening of a controversial documentary ‘India’s daughter’ on the Delhi gang rape incident as it carried an interview of one of the convicted persons.
March 9: Nagaland government blocks the Internet and mobile data services and bans the circulation of videos and photographs of the lynching of Syed Sarif alias Farid Khan by a huge mob.
March 18: Mere criticism is not seditious, rules the Bombay High Court upholding a petition that challenged the charge of sedition against cartoonist Aseem Trivedi.
March 24: In a landmark judgement, the Supreme Court of India strikes down Sec 66 A of the amended Information Technology Act, 2000 as ‘unconstitutional’.

April
April 8: The Supreme Court seeks the government’s view on the decriminalizing of defamation, while hearing a batch of petitions led by BJP MP Subramanian Swamy challenging the constitutional validity of defamation.
April 13: More than one lakh people from all walks of life send in their recommendations to save the principle of net neutrality following TRAI recommendations on OTT services and online media.
April 28: The Shiv Sena moves a privilege motion against writer and columnist Shobhaa De for her tweets allegedly insulting Maharashtrian culture.

May 14: The Supreme Court upholds the framing of obscenity charges against poet Vasant Dattatreya Gurjar for his poem on Gandhi.
May 29: The Meghalaya High Court imposes a ban on media coverage of bandh calls issued by insurgency groups.

June 6: Bilal Bahadur, photo editor of Kashmir Life, is attacked and severely beaten by a mob in Srinagar, incensed at coverage of their Friday protests in the Nowhatta area.
June 7: The Ministry of Home Affairs denies security clearance to Sun TV for 33 TV channels which could lead to their shut down. Pending criminal cases against the company’s owners is cited as the reason.
June 8: Shajahanpur-based journalist Jagendra Singh dies of burn injuries, eight days after he alleged in a video that he was set on fire by a group of police and supporters of Uttar Pradesh Minister for Dairy Development, Ram Murti Verma.
June 12: Kanpur-based journalist Deepak Mishra is shot at by unidentified persons. He says the attack was after he wrote a series of articles on gambling dens in a small newspaper Dainik Mera Sach, but police say it because of a personal dispute with a neighbour.
June 15: Haider Khan, a journalist in Uttar Pradesh's Pilibhit district, is brutally assaulted, tied to a motorcycle and dragged on the ground, allegedly for his reports on dubious land deals.
June 22: Sandeep Kothari, a 40-year-old journalist based in Jabalpur, is allegedly kidnapped from Balagat in Madhya Pradesh and set on fire. He dies later. He had written against the illegal mining mafia and was being pressurized to withdraw a case he had filed on this topic.
June 23: BJP leader Subramanian Swamy, who is facing multiple cases in Delhi, Mumbai, Assam, Mohali and Kerala, challenges the hate speech provisions of Sections 153, 153A, 153B, 295, 295A, 298 and 505 of the Indian Penal Code as violative of his freedom of speech.

July
July 5:  Akshay Singh, a reporter with Aaj Tak channel, who was covering the Vyapam scam in Madhya Pradesh, dies in mysterious circumstances in Meghnagar near Jhabua, minutes after interviewing the father of Namrata Damor, a student whose body was found near a railway track in Ujjain district of the state. At least 23 people had died an unnatural death, according to a special investigative team probing the scam.

August  
August 8: Raja Chaturvedi, a journalist working in Kannauj district in Uttar Pradesh, is shot dead just outside his house by unidentified persons.
August 8: Sanjay Pathak, a stringer with a local Hindi newspaper, in Uttar Pradesh’s Bareilly district, is killed by two persons in Faridpur area in the district.
August 27: A Rs 250-crore defamation case is filed by Essar Steel against Caravan magazine.
August 27: The Maharashtra government issues a circular to all police stations directing that sedition charges be applied if citizens criticize public officials or politicians.
August 30: Former Vice Chancellor of Hampi University, rationalist and well known Kannada writer MM Kalburgi, is shot dead in his residence. He was attacked for his views against idolatary in a campaign of the Vishwa Hindu Parishad.

September
September 2: The Internet is blocked in Manipur indefinitely after an outbreak of violence in Churachandpur
September 4: Hindu groups force literary critic M M Basheer to stop writing a regular column on the Ramayana for the Malayalam daily Mathrubhumi.
September 9: The Gujarat High Court upholds a ban on internet services during the Patel agitation in Gujarat.
September 24: Internet services are  suspended in Jammu and Kashmir to ‘stop miscreants from posting objectionable pictures’ of beef slaughter during the Eid festival. The ban on internet services was re-imposed in November for the visit of Prime Minister NarendraModi.
September 30: Freelance journalist Ajay Vidrohi is shot dead in Sitamarhi, days before the Bihar state elections.

October
October 10: Hemant Yadav, a  journalist with a local news channel, is shot dead by motorcycle-borne gunmen in Chandauli district in Uttar Pradesh.
October 10: Sudheendra Kulkarni, who heads the Observer Research Foundation, is attacked by Shiv Sena party members and his face blackened with ink for organizing a book launch of former Pakistan foreign minister Khurshid Mahmud Kasuri.
October 27: Mithilesh Pandey, a reporter with Dainik Jagran is shot dead in his house in Khastha village in Gaya district of Bihar.
October 7: Acclaimed writer Nayantara Sahgal and poet Ashok Vajpayi return their Sahitya Akademi awards to protest the threats to free speech and intolerance in the wake of the killing of Professor Kalburgi and the Dadri lynching of Mohammed Akhlaq and are followed suit by  a number of eminent writers, film-makers and poets. Eminent writer Uday Prakash had returned his award in September.
October 7: Two concerts of Pakistani ghazal singer Ghulam Ali in Mumbai and Pune in Maharashtra are cancelled following protests by the Shiv Sena which is opposed to all ‘cultural ties’ with Pakistan.
October 9: The Delhi High Court seeks the CBFC’s response to a petition on the denial of a certificate for ‘En Dino Muzaffarnagar’, a documentary on the Muzaffarnagar riots made by the late Shubradeep Chakravorty and Meera Chaudhary. The film was to be granted an ‘A’ certificate.
October 10: Adivasi journalist Someru Nag and Hindi media reporter Santosh Yadav are arrested by Chhattisgarh police on suspicion of supporting Maoists.  Despite protests by local journalists and a signature campaign by academics and activists across India appealing for their release, the duo are still in jail.
October 12: Indo-Pak band Mekaal Hasan Band is not allowed to perform in Ahmedabad’s Sheth CN College of Fine Arts after a scheduled concert was disallowed by the college trustees in the wake of a protest by the Shiv Sena.
October 31: Tamil folk singer S Kovan is slapped with a sedition case for singing songs critical of Tamil Nadu Chief Minister J Jayalalithaa and her liquor policy. Kovan heads the Makkal Kalai Ilakkiya Kazhagam or People’s Art and Literary Association, a 30-year old cultural organization that stages plays on social issues.

November
Nov 19: The Director of Film Festivals drops the entire students’ section from the IFFI fearing trouble from students of the FTII who have been protesting over the lack of transparency in appointments to the Governing Council. A 139-day strike by the students over the appointment of Gajendra Chauhan and four others ends inconclusively.
Nov 20: The CBFC cuts four scenes from ‘Spectre’, the James Bond film, two for alleged profanity and two for ‘excessive kissing’.
Nov 23: Newspapers in Nagaland carry blank editorials to register their misgivings at the directive of the Assam Rifles that they should not cover banned groups

December
December 1: Several offices of the Marathi daily Lokmata reattacked for publishing an allegedly blasphemous cartoon depicting ISIS funding in an article titled 'ISIS cha Paisa' (ISIS' money).
Dec 9: Mohammed Wasim-ul-Haq, the chief editor of Akhbar-e-Mashriq, an Urdu daily from Kolkata, is taken into preventive custody by police in Delhi for an article critical of the provocative statements of a Hindu leader.
Dec 10: The Tamil Nadu government files sedition charges against a Tamil news weekly 'Namadhu Manasatchi' for allegedly publishing a false and seditious report on public healthcare.
Dec 10: Tamil Nadu Handloom and Textile Minister S. Gokula Indira files a criminal defamation case against Tamil weekly Ananda Vikatan for publishing an article criticizing the ministry.
Dec 16: Ravi Shankar Prasad, Minister of Communications,  informs Parliament that the Government has blocked 844 social media pages till November under the IT Act.
Dec 17: Newspapers in Imphal shut down for a day following a bomb threat to the editor-in-chief of Impact TV.
Dec 21: The Rajasthan government blocks Internet services in some districts indefinitely after communal clashes in the districts of Nagaur, Dungarpur, Udaipur, Bhilwara and other parts of the state.
Dec 26: As part of the ongoing controversy over alleged corruption in the Delhi and District Cricket Association, Tejbir Singh, father of Delhi cricketer Himmat Singh, files a defamation suit against suspended BJP leader Kirti Azad, and former cricketers Bishan Singh Bedi and Surender Khanna.
Dec 26: A petition is filed in the Madras High Court by Paneerselvi, seeking an interim stay on the release of Ram Gopal Verma’s film ‘Killing Veerappan’ because the “entire movie is filled up with false information which is nothing but creating law and order problems in Tamil Nadu."
Dec 27: Kerala photographer Rafeeque Taliparamba’s studio is burnt down after he questioned certain Islamic practices including the tradition of purdah on a WhatsApp group.
Dec 30: The Delhi and District Cricket Association files a defamation case against Delhi Chief Minister Arvind Kejriwal and suspended BJP leader Kirti Azad for their “wild and baseless” allegations of corruption against the cricket body.
Dec 31: Desiya Murpokku Dravida Kazhagam (DMDK) chief and Tamil film actor Vijayakanth spits at journalists and dares them to ask Chief Minister  J. Jayalalithaa similar questions about the upcoming assembly elections.

Sectorwise developments

FREE SPEECH AND THE JUDICIARY
The year saw a number of legal developments with implications for free speech.  The most significant of these came in the first quarter of the year.
On March 24 the Supreme Court Justices J Chelameswar and R F Nariman struck down Section 66A of the Information Technology Act, 2000 (which criminalized annoying, menacing and offensive speech), along with Section 118(d) of the Kerala Police Act (which criminalized annoying speech) for violating the fundamental right to free speech enshrined in Article 19(1)(a) of the Constitution. Section 79 of the IT Act which immunizes intermediaries from liability was held valid by the Court subject to certain conditions. Only Section 69A of the IT Act, which allows the government to block websites, on certain limited grounds, was held entirely constitutional by the Court.

Several cases of defamation and sedition as well as several media related cases went up to the apex court in the course of year. Most of the time, it weighed in on the side of the freedom of speech of the accused.
The SC dismisses a Tamil Nadu government petition charging folk singer Kovan with sedition.
It extends the stay on defamation proceedings against DMKD leader Vijayakanth by the Tamil Nadu government.
The apex court pulls up the state government for filing so  many defamation cases.
 It also steps in to protect journalists from similar actions by the Delhi Government
The Supreme Court stays a Delhi government circular on defamation
The Supreme Court stays defamation proceedings filed against journalists and publishers in older cases.
It stays defamation proceedings against Rajdeep Sardesai and seven others.
It also stays proceedings against AroonPurie.

In a case of defamation being filed against publications and writers, the Supreme Court declines to transfer a defamation suit against Caravan by EssartoDelhi.
But in the case of the Indian Institute of Planning and Management, the Court calls the institute’s Rs 50 crore suit against Caravan bogus and lets the case be transferred to Delhi.
In June, the Supreme Court has to step into the case of the Union Home Ministry denying security clearance to Sun TV on account of criminal cases pending against them. It stays the Tamil Nadu High Court order cancelling Former Union Telecom Minister Dayanidhi Maran’sbail.

In 2015,  the Law Commission recommended doing away with the death penalty for all offences except terrorism and sedition. But sedition became such a frequently imposed charge that the prospect of such a recommendation is worrying. There were 26 cases that we captured from media reports but the number could be larger.
But in the case of Hardik Patel and the charge of sedition levied against him by the Gujarat government, there were several successive developments with the Supreme Court initially refusing to quash  sedition charges against him, and then transferring his plea against the sedition charge to another bench in November.
In terms of restraining the media in 2015, the Supreme Court observed in  August that the government should regulate social media to curb malicious campaigns.

GOVERNMENT ACTIONS IN THE REALM OF FREE SPEECH
Between the Central Board of Film Certification, the Ministry of Information  & Broadcasting  and the Ministry of Home Affairs,  a hyperactive government did more than  its share of censorship and policing.
These are the instances we recorded stretching across the categories defined in the opening table of this report.

ਨਿਆਂਇਕ ਅਸਹਿਣਸ਼ੀਲਤਾ?

ਭਾਰਤੀ ਨਿਆਂਤੰਤਰ, ਖ਼ਾਸ ਕਰਕੇ ਉਚੇਰੀ ਜੁਡੀਸ਼ਰੀ ਬਹੁਤ ਫਰਾਖ਼ਦਿਲ ਹੈ। ਕੌਮੀ ਪ੍ਰਬੰਧ ਵਿੱਚ ਉਦਾਰਵਾਦ ਦਾ ਪਰਚਮ ਬੁਲੰਦ ਰੱਖਣ ਵਿੱਚ ਇਸ ਦੀ ਅਹਿਮ ਭੂਮਿਕਾ ਹੈ। ਇਸ ਦੀ ਇੱਕ ਮਿਸਾਲ ਸਾਲ 1999 ਦਾ ਇੱਕ ਹੁਕਮ ਹੈ। ਬੁੱਕਰ ਪੁਰਸਕਾਰ ਜੇਤੂ ਲੇਖਕ ਤੇ ਸਮਾਜਿਕ ਕਾਰਕੁਨ ਅਰੁੰਧਤੀ ਰਾਏ ਖ਼ਿਲਾਫ਼ ਅਦਾਲਤੀ ਤੌਹੀਨ ਦੇ ਕੇਸ ਵਿੱਚ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਕਿਹਾ ਸੀ,’’ਅਦਾਲਤ ਦੇ ਮੋਢੇ ਏਨੇ ਕੁ ਚੌੜੇ ਜ਼ਰੂਰ ਹੋਣੇ ਚਾਹੀਦੇ ਹਨ ਕਿ ਉਹ ਲੇਖਕਾਂ ਤੇ ਚਿੰਤਕਾਂ ਦੀਆਂ ‘ਅਨਿਆਂਪੂਰਣ’ ਟਿੱਪਣੀਆਂ ਦੇ ਬਾਣ ਵੀ ਅਹਿੱਲ ਰਹਿੰਦਿਆਂ ਝੱਲ ਸਕਣ।’’ ਅਜਿਹੀ ਉਦਾਰਵਾਦੀ ਸੋਚ ਦੇ ਬਾਵਜੂਦ ਹੁਣ ਬੰਬਈ ਹਾਈ ਕੋਰਟ ਦੇ ਨਾਗਪੁਰ ਬੈਂਚ ਨੇ ਅਰੁੰਧਤੀ ਦੇ ਖ਼ਿਲਾਫ਼ ਫ਼ੌਜਦਾਰੀ ਮਾਣਹਾਨੀ ਦੀ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਕਰ ਦਿੱਤੀ ਹੈ ਕਿਉਂਕਿ ਅਰੁੰਧਤੀ ਨੇ ਪ੍ਰੋ. ਜੀ.ਐੱਨ. ਸਾਈਬਾਬਾ ਕੇਸ ਵਿੱਚ ‘’ਨਿਆਂ ਵਿਵਸਥਾ ‘ਚ ਦਖ਼ਲ ਦੇਣ ਦੀ ਕੋਸ਼ਿਸ਼ ਕੀਤੀ।’’ ਉਸ ਤੋਂ 25 ਜਨਵਰੀ ਤਕ ਜਵਾਬ ਤਲਬ ਕੀਤਾ ਗਿਆ ਹੈ। ਹਾਈ ਕੋਰਟ ਦੀ ਇਹ ਕਾਰਵਾਈ ਚਿੰਤਾਜਨਕ ਹੈ ਅਤੇ ਕੁਝ ਕਾਨੂੰਨੀ ਮਾਹਿਰ ਇਸਨੂੰ ‘ਅਦਾਲਤੀ ਅਸਹਿਣਸ਼ੀਲਤਾ’ ਦੱਸ ਰਹੇ ਹਨ।
ਨਿਆਂਇਕ ਅਧਿਕਾਰੀ, ਖ਼ਾਸ ਤੌਰ ‘ਤੇ ਸੀਨੀਅਰ ਜੱਜ ਆਪਣੇ ਹੁਕਮਾਂ ਜਾਂ ਫ਼ੈਸਲਿਆਂ ਬਾਰੇ ਪੱਤਰਕਾਰਾਂ ਤੇ ਲੇਖਕਾਂ ਦੀਆਂ ਟਿੱਪਣੀਆਂ ਦਾ ਬਹੁਤਾ ਨੋਟਿਸ ਨਹੀਂ ਲੈਂਦੇ। ਮੀਡੀਆ, ਖ਼ਾਸ ਕਰਕੇ ਸੋਸ਼ਲ ਮੀਡੀਆ ਵਿੱਚ ਅਦਾਲਤੀ ਫ਼ੈਸਲਿਆਂ ਦੀ ਨੁਕਤਾਚੀਨੀ ਵੀ ਆਮ ਰੁਝਾਨ ਹੈ। ਜਦੋਂ ਤਕ ਕੋਈ ਪੱਤਰਕਾਰ ਜਾਂ ਲੇਖਕ ਆਪਣੀ ਨੁਕਤਾਚੀਨੀ ਨੂੰ ਅਦਾਲਤੀ ਫ਼ੈਸਲੇ ਦੀਆਂ ਖ਼ਾਮੀਆਂ ਤੇ ਅਸੰਗਤੀਆਂ ਤਕ ਸੀਮਤ ਰੱਖਦਾ ਹੈ, ਅਤੇ ਫ਼ੈਸਲਾ ਦੇਣ ਵਾਲੇ ਜੱਜ ਦੇ ਨਿੱਜ ਜਾਂ ਕਾਰਜ-ਸ਼ੈਲੀ ‘ਤੇ ਨਾਂਹਮੁਖੀ ਹਮਲਾ ਨਹੀਂ ਕਰਦਾ, ਉਦੋਂ ਤਕ ਅਜਿਹੀ ਨੁਕਤਾਚੀਨੀ ਸਹਿਣ ਦਾ ਮਾਦਾ ਅਦਾਲਤਾਂ ਨੂੰ ਦਿਖਾਉਣਾ ਚਾਹੀਦਾ ਹੈ ਅਤੇ ਇਹ ਦਿਖਾਇਆ ਵੀ ਜਾਂਦਾ ਹੈ। ਅਰੁੰਧਤੀ ਨਾਲ ਜੁੜੇ ਤਾਜ਼ਾਤਰੀਨ ਮਾਮਲੇ ਵਿੱਚ ਅਜਿਹਾ ਨਹੀਂ ਕੀਤਾ ਗਿਆ। ਇੱਕ ਅੰਗਰੇਜ਼ੀ ਹਫ਼ਤਾਵਾਰੀ ਰਸਾਲੇ ਵਿੱਚ ਮਈ 2015 ‘ਚ ਪ੍ਰਕਾਸ਼ਿਤ ਉਸ ਦੇ ਲੇਖ ਦੇ ਆਧਾਰ ‘ਤੇ ਹਾਈ ਕੋਰਟ ਨੇ ਉਸ ਨੂੰ ਫ਼ੌਜਦਾਰੀ ਮਾਣਹਾਨੀ ਦਾ ਨੋਟਿਸ 24 ਦਸੰਬਰ ਨੂੰ ਜਾਰੀ ਕਰ ਦਿੱਤਾ। ਲੇਖ ਵਿੱਚ ਅਰੁੰਧਤੀ ਨੇ ਦਿੱਲੀ ਯੂਨੀਵਰਸਿਟੀ ਦੇ ਪ੍ਰੋ. ਜੀ.ਐੱਨ. ਸਾਈਬਾਬਾ ਨੂੰ ਜ਼ਮਾਨਤ ਨਾ ਦੇਣ ਦੇ ਅਦਾਲਤੀ ਫ਼ੈਸਲੇ ਦੀ ਨੁਕਤਾਚੀਨੀ ਕੀਤੀ ਸੀ ਅਤੇ ਉਸ ਦੀ ਗ੍ਰਿਫ਼ਤਾਰੀ, ਨਜ਼ਰਬੰਦੀ ਅਤੇ ਜੇਲ੍ਹ ‘ਚ ਉਸ ਦੀ ਡਿੱਗਦੀ ਸਿਹਤ ਉੱਤੇ ਫ਼ਿਕਰਮੰਦੀ ਪ੍ਰਗਟਾਉਂਦਿਆਂ ਨਿਆਂਪ੍ਰਬੰਧ ਵਿੱਚ ‘ਮਾਨਵੀ ਸੰਵੇਦਨਾਵਾਂ’ ਵਿਕਸਿਤ ਕਰਨ ਦਾ ਸੱਦਾ ਦਿੱਤਾ ਸੀ। ਨਕਸਲੀਆਂ ਨਾਲ ਸਬੰਧਾਂ ਦੇ ਦੋਸ਼ ਹੇਠ ਮਹਾਰਾਸ਼ਟਰ ਪੁਲੀਸ ਵੱਲੋਂ ਗ੍ਰਿਫ਼ਤਾਰ ਪ੍ਰੋ. ਸਾਈਬਾਬਾ ਸਰੀਰ ਹੇਠਲਾ ਹਿੱਸਾ ਨਕਾਰਾ ਹੋਣ ਕਾਰਨ ਵ੍ਹੀਲਚੇਅਰ ‘ਤੇ ਨਿਰਭਰ ਹਨ। ਉਨ੍ਹਾਂ ਦੀ ਵਿਚਾਰਧਾਰਾ ਚਾਹੇ ਕੁਝ ਵੀ ਹੋਵੇ, ਇਨਸਾਨੀਅਤ ਦਾ ਤਕਾਜ਼ਾ ਹੈ ਕਿ ਉਨ੍ਹਾਂ ਨਾਲ ਵੱਧ ਮਾਨਵੀਅਤਾ ਨਾਲ ਪੇਸ਼ ਆਇਆ ਜਾਵੇ। ਅਜਿਹੀ ਹੀ ਮੰਗ ਆਪਣੀ ਤਰਜ਼-ਏ-ਕਲਮ ਅਤੇ ਅੰਦਾਜ਼ ਰਾਹੀਂ ਅਰੁੰਧਤੀ ਰਾਏ ਨੇ ਆਪਣੀ ਰਚਨਾ ਵਿੱਚ ਉਠਾਈ ਸੀ।
ਇਹ ਵੱਖਰੀ ਗੱਲ ਹੈ ਕਿ ਹਾਈ ਕੋਰਟ ਦੇ ਜਸਟਿਸ ਏ.ਬੀ. ਚੌਧਰੀ ਨੂੰ ਇਸ ਰਚਨਾ ਵਿੱਚੋਂ ਨਿਆਂਇਕ ਵਿਵਸਥਾ ਨੂੰ ਪ੍ਰਭਾਵਿਤ ਕਰਨ ਦੀ ‘ਸਾਜ਼ਿਸ਼’ ਨਜ਼ਰ ਆਈ। ਉਨ੍ਹਾਂ ਦਾ ਮੱਤ ਹੈ ਕਿ ਸੈਸ਼ਨ ਕੋਰਟ ਤੇ ਹਾਈ ਕੋਰਟ ਦੇ ਸਿੰਗਲ ਜੱਜ ਬੈਂਚ ਵੱਲੋਂ ਸਾਈਬਾਬਾ ਦੀ ਅਰਜ਼ੀ ਖਾਰਿਜ ਕੀਤੇ ਜਾਣ ਤੋਂ ਬਾਅਦ ਇਹ ਲੇਖ ‘ਨਿਆਂਪ੍ਰਬੰਧ ‘ਤੇ ਹਾਵੀ ਹੋਣ ਲਈ ਲਿਖਿਆ ਗਿਆ।’ ਫਾਜ਼ਿਲ ਜੱਜ ਅਨੁਸਾਰ ਪ੍ਰੋ. ਸਾਈਬਾਬਾ ਨੂੰ ਜ਼ਮਾਨਤ ਨਾ ਦੇਣ ਨੂੰ ਮਾਇਆ ਕੋਡਨਾਨੀ, ਬਾਬੂਲਾਲ ਬਜਰੰਗੀ ਤੇ ਅਮਿਤ ਸ਼ਾਹ ਦੀ ਗੁਜਰਾਤ ਕਤਲੇਆਮ ਦੇ ਕੇਸਾਂ ਵਿੱਚ ਜ਼ਮਾਨਤ ਨਾਲ ਜੋੜ ਕੇ ਅਰੁੰਧਤੀ ਨੇ ਇਹ ਪ੍ਰਭਾਵ ਦੇਣ ਦਾ ਯਤਨ ਕੀਤਾ ਕਿ ਉੱਚ ਅਦਾਲਤਾਂ ਵੀ ਦਬਾਅ ਹੇਠ ਕੰਮ ਕਰਦੀਆਂ ਹਨ। ਉਨ੍ਹਾਂ ਨੇ ਲੇਖਕ ਵੱਲੋਂ ਸਰਕਾਰ ਤੇ ਪੁਲੀਸ ਪ੍ਰਤੀ ਵਰਤੀ ‘ਫਾਹਸ਼’ ਭਾਸ਼ਾ ਉੱਤੇ ਵੀ ਇਤਰਾਜ਼ ਕੀਤਾ।
ਅਰੁੰਧਤੀ ਦੀ ਤਿੱਖੇ ਸੁਰ ਵਿੱਚ ਬੋਲਣ ਤੇ ਤਿੱਖੇ ਸੁਰ ਵਿੱਚ ਲਿਖਣ ਦੀ ਆਦਤ ਤੋਂ ਭਾਰਤੀ ਵਿਚਾਰਵਾਨ, ਸਮਾਜਿਕ ਕਾਰਕੁਨ ਅਤੇ ਉਸ ਦੇ ਪ੍ਰਸ਼ੰਸਕ ਤੇ ਆਲੋਚਕ ਚੰਗੀ ਤਰ੍ਹਾਂ ਵਾਕਫ਼ ਹਨ। ਉਸ ਦਾ ਯਕੀਨ ਹੈ ਕਿ ਸਮਾਜਿਕ ਨਿਆਂ ਨਾਲ ਜੁੜੇ ਮਾਮਲਿਆਂ ਵਿੱਚ ਕੜਕੀਲੀ ਪਹੁੰਚ ਤੋਂ ਬਿਨਾਂ ਸੁਣਵਾਈ ਹੀ ਨਹੀਂ ਹੁੰਦੀ। ਅਦਾਲਤੀ ਕਰੋਪੀ ਦਾ ਵਿਸ਼ਾ ਬਣੀ ਰਚਨਾ ਉਸਦੀ ਟਰੇਡਮਾਰਕ ਸ਼ੈਲੀ ਵਿੱਚ ਹੈ। ਇਸ ਵਿੱਚ ਨਿਆਂਤੰਤਰ ਬਾਰੇ ਟਿੱਪਣੀਆਂ ਹਨ, ਓਨੀਆਂ ਹੀ ਤਿੱਖੀਆਂ ਜਿੰਨੀਆਂ ਉਸਦੀਆਂ ਦਰਜਨਾਂ ਰਚਨਾਵਾਂ ਵਿੱਚ ਰਹੀਆਂ ਹਨ, ਪਰ ਕਿਸੇ ‘ਤੇ ਵਿਅਕਤੀਗਤ ਵਾਰ ਨਹੀਂ। ਅਦਾਲਤੀ ਪ੍ਰਬੰਧ ਨਾਲ ਅਰੁੰਧਤੀ ਦੀ ਖਹਿਬਾਜ਼ੀ ਕੋਈ ਨਵੀਂ ਗੱਲ ਨਹੀਂ। ਜਿਸ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ 1999 ਵਿੱਚ ਉਸ ਦੀ ਆਲੋਚਨਾ ਨੂੰ ਫਰਾਖ਼ਦਿਲੀ ਨਾਲ ਜਰਨ ਦੀ ਗੱਲ ਕੀਤੀ ਸੀ, ਉਸੇ ਸਰਬਉੱਚ ਅਦਾਲਤ ਨੇ ਮਾਰਚ 2002 ਵਿੱਚ ਨਰਮਦਾ ਬਚਾਓ ਅੰਦੋਲਨ ਨਾਲ ਜੁੜੇ ਪ੍ਰਸੰਗ ਵਿੱਚ ਫ਼ੌਜਦਾਰੀ ਮਾਣਹਾਨੀ ਦਾ ਦੋਸ਼ੀ ਠਹਿਰਾ ਕੇ ਇੱਕ ਦਿਨ ਦੀ ਸਾਧਾਰਨ ਕੈਦ ਤੇ 2000 ਰੁਪਏ ਜੁਰਮਾਨੇ ਦੀ ਸਜ਼ਾ ਸੁਣਾਈ ਸੀ। ਅਗਲੇ ਦਿਨ ਉਹ ਭਾਵੇਂ ਜੁਰਮਾਨਾ ਅਦਾ ਕਰਕੇ ਰਿਹਾਅ ਹੋ ਗਈ ਸੀ, ਪਰ ਉਸ ਦੇ ਨਿੰਦਕਾਂ ਨੂੰ ਇਹ ਕਹਿਣ ਦਾ ਮੌਕਾ ਅਵੱਸ਼ ਮਿਲ ਗਿਆ ਸੀ ਕਿ ਤਿੰਨ ਮਹੀਨੇ ਲਈ ਹੋਰ ਕੈਦ ਕੱਟਣ ਦੀ ਥਾਂ ਜੁਰਮਾਨਾ ਅਦਾ ਕਰਕੇ ਉਸ ਨੇ ਅਦਾਲਤੀ ਫ਼ਤਵੇ ਨੂੰ ‘ਖਿੜੇ ਮੱਥੇ’ ਪ੍ਰਵਾਨ ਕਰ ਲਿਆ ਹੈ। ਇਹ ਵੱਖਰੀ ਗੱਲ ਹੈ ਕਿ ਨਿੰਦਕਾਂ ਦੇ ਇਸ ਰੁਖ਼ ਦੇ ਬਾਵਜੂਦ ਅਰੁੰਧਤੀ ਦੀਆਂ ਲੇਖਣੀਆਂ ਜਾਂ ਤਕਰੀਰਾਂ ਵਿੱਚੋਂ ਪ੍ਰਚੰਡਤਾ ਮੱਠੀ ਨਹੀਂ ਪਈ।
ਨਿਆਂ ਪ੍ਰਬੰਧ ਅੰਦਰਲੀਆਂ ਖ਼ੂਬੀਆਂ ਖ਼ਾਮੀਆਂ ਭਾਵੇਂ ਸਾਥੋਂ ਛੁਪੀਆਂ ਨਹੀਂ, ਫਿਰ ਵੀ ਵਡੇਰੇ ਜਨਹਿੱਤ ਵਿੱਚ ਇਸ ਦਾ ਰੋਲ ਗੌਰਵਸ਼ਾਲੀ ਰਿਹਾ ਹੈ। ਬਹੁਤ ਸਾਰੇ ਅਜਿਹੇ ਫ਼ੈਸਲੇ ਹਨ ਜਿਨ੍ਹਾਂ ਨਾਲ ਅਸੀਂ ਸਮਾਜਿਕ, ਰਾਜਨੀਤਕ ਜਾਂ ਵਿਚਾਰਧਾਰਕ ਪੱਧਰ ਪੱਖੋਂ ਸਹਿਮਤ ਹੋਈਏ ਜਾਂ ਨਾ, ਉਨ੍ਹਾਂ ਦੀ ਕਾਨੂੰਨੀ ਪ੍ਰਮਾਣਿਕਤਾ ਅਤੇ ਤਰਕਸੰਗਤਤਾ ਬਾਰੇ ਸ਼ਿਕਵੇ ਨਹੀਂ ਕੀਤੇ ਜਾ ਸਕਦੇ। ਇਹੀ ਕਾਰਨ ਹੈ ਕਿ ਨਿਆਂਤੰਤਰ ਉੱਤੇ ਆਮ ਨਾਗਰਿਕ ਦਾ ਵਿਸ਼ਵਾਸ, ਭਾਰਤੀ ਸਟੇਟ ਦੇ ਬਾਕੀ ਅੰਗਾਂ ਨਾਲੋਂ ਵੱਧ ਹੈ। ਅਜਿਹੇ ਆਲਮ ਵਿੱਚ ਜਦੋਂ ਕੋਈ ਹਾਈ ਕੋਰਟ ਉਦਾਰਵਾਦੀ ਸੋਚ ਤੇ ਮਾਨਤਾਵਾਂ ਖ਼ਿਲਾਫ਼ ਭੁਗਤਦਾ ਜਾਪੇ ਤਾਂ ਉੱਥੇ ਵੀ ਸਹਿਣਸ਼ੀਲਤਾ ਖ਼ਤਰੇ ‘ਚ ਨਜ਼ਰ ਆਉਣ ਲੱਗਦੀ ਹੈ। ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਜੱਜ ਤੇ ਫਿਰ ਭਾਰਤ ਦੇ ਚੀਫ਼ ਜਸਟਿਸ ਵਜੋਂ ਆਪਣੇ ਕਾਰਜਕਾਲ ਦੌਰਾਨ ਕਈ ਮਹੱਤਵਪੂਰਨ ਫ਼ੈਸਲੇ ਦੇਣ ਵਾਲੇ ਸਵਰਗੀ ਜਸਟਿਸ ਜੇ.ਐੱਸ. ਵਰਮਾ ਦਾ ਕਥਨ ਸੀ,’’ਅਦਾਲਤੀ ਮਾਣਹਾਨੀ ਦੇ ਅਧਿਕਾਰ ਦੀ ਵਰਤੋਂ ਬਹੁਤ ਘੱਟ ਤੇ ਬਹੁਤ ਸੰਭਲ ਕੇ ਕਰਨੀ ਚਾਹੀਦੀ ਹੈ, ਉਹ ਵੀ ਨਿਆਂ ਦੀ ਜਾਣ-ਬੁੱਝ ਕੇ ਅਵੱਗਿਆ ਕਰਨ ਵਾਲਿਆਂ ਖ਼ਿਲਾਫ਼; ਸਰਕਾਰ ਦੇ ਆਲੋਚਕਾਂ ਖ਼ਿਲਾਫ਼ ਨਹੀਂ।’’ ਅਰੁੰਧਤੀ ਰਾਏ ਦੂਜੀ ਸ਼੍ਰੇਣੀ ਵਿੱਚ ਆਉਂਦੀ ਹੈ ਅਤੇ ਜਸਟਿਸ ਵਰਮਾ ਵਾਲਾ ਸਿਧਾਂਤ ਉਸ ‘ਤੇ ਅਵੱਸ਼ ਲਾਗੂ ਹੋਣਾ ਚਾਹੀਦਾ ਹੈ। ਨਿਆਂਇਕ ਫਰਾਖ਼ਦਿਲੀ ਦਾ ਤਕਾਜ਼ਾ ਵੀ ਇਹੋ ਹੈ।

ਬੰਬੇ ਹਾਈ ਕੋਰਟ ਦੇ ਨਾਗਪੁਰ ਬੈਂਚ ਦੇ ਜੱਜ ਸ਼੍ਰੀ ਏ ਬੀ ਚੌਧਰੀ ਨੇ 23.12.2015 ਦੇ ਫੈਸਲੇ ਰਾਹੀਂ ਪ੍ਰੋ: ਸਾਈਂਬਾਬਾ ਦੀ ਜਮਾਨਤ ਰੱਦ ਕਰਦਿਆਂ ਅਰੁੰਧਤੀ ਰਾਇ ਨੂੰ ਅਦਾਲਤ ਦੀ ਤੌਹੀਨ ਬਾਰੇ ਨੋਟਿਸ ਜਾਰੀ ਕੀਤਾ ਹੈ।
ਅਰੁੰਧਤੀ ਰਾਇ ਨੇ ਮਨੁਖੀ ਹਕਾਂ ਦੇ ਉਘੇ ਕਾਰਕੁੰਨ ਦਿਲੀ ਯੂਨੀਵਰਸਿਟੀ ਦੇ ਪ੍ਰੋ: ਸਾਈਂਬਾਬਾ ਨੂੰ, ਜੋ 90% ਅਪੰਗ ਹਨ, ਝੂਠੇ ਕੇਸਾਂ ਵਿਚ ਲੰਮਾ ਅਰਸਾ ਜੇਲ੍ਹ 'ਚ ਤਾੜੀ ਰਖਣ ਖਿਲਾਫ ਆਊਟਲੁਕ ਰਸਾਲੇ 'ਚ ਇਕ ਲੇਖ ਲਿਖਿਆ ਸੀ। ਇਸ ਲੇਖ 'ਚ ਅਰੁੰਧਤੀ ਰਾਇ ਨੇ ਪੁਲਸ ਤੇ ਸਰਕਾਰ ਦੀ ਡਾਢੀ ਅਲੋਚਨਾ ਕੀਤੀ ਸੀ ਤੇ ਗੁਜਰਾਤ ਦੰਗਿਆਂ ਦੇ ਸਜ਼ਾਜਾਫਤਾ ਦੋਸ਼ੀਆਂ ਕੋਡਨਾਨੀ, ਬਾਬੂ ਬਜਰੰਗੀ ਵਰਗੇ ਕੇਸਾਂ ਨਾਲ ਤੁਲਨਾ ਕਰਦਿਆਂ ਅਦਾਲਤਾਂ ਦੇ ਪਖਪਾਤੀ ਰਵਈਏ ਬਾਰੇ ਵੀ ਟਿਪਣੀਆਂ ਕੀਤੀਆਂ ਸਨ।

ਅਦਾਲਤ ਦੇ ਇਸ ਹੁਕਮ ਵਿਚ “ਹਕੂਮਤ ਵਿਰੋਧੀ ਵਿਚਾਰਾਂ ਨੂੰ ਜੁਰਮ ਦੇ ਘੇਰੇ ‘ਚ ਲਿਆਉਣ” ਦੇ ਅਨਿਆਂਈ ਸਿਧਾਂਤ ਨੂੰ ਅਮਲੀ ਜਾਮਾ ਪਹਿਨਾਇਆ ਗਿਆ ਹੈ। ਇਸ ਦਾ ਮਤਲਬ ਹੈ ਕਿ ਹੁਣ "ਅਸਹਿਮਤੀ" ਨੂੰ ਜੁਰਮ ਮੰਨ ਲਿਆ ਗਿਆ ਹੈ।
ਪੁਲਸ ਦੀਆਂ ਵਧੀਕੀਆਂ ਖਿਲਾਫ ਅਵਾਜ ਉਠਾੳੁਣ ਨੂੰ ਨਿਆਂ ਦੇ ਕੰਮ 'ਚ ਦਖਲ ਦੇਣ ਦੇ ਨਾਂ ਥਲੇ ਜੁਰਮ ਬਣਾਇਆ ਜਾ ਰਿਹਾ ਹੈ। ਅਦਾਲਤ ਦੇ ਉਕਤ ਫੈਸਲੇ ਦੀ ਅਨਿਆਂਈ ਪਿਰਤ ਜੇਕਰ ਅਦਾਲਤਾਂ ਦੇ ਚਲਣ ਵਜੋਂ ਸਥਾਪਤ ਹੋ ਜਾਂਦੀ ਹੈ ਤਾਂ ਇਹ ਅਲੋਚਨਾ ਦੇ ਹੱਕ ਤੇ ਗੰਭੀਰ ਹਮਲਾ ਹੈ।

ਜਸਟਿਸ ਸ਼੍ਰੀ ਚੌਧਰੀ ਜਨਤਕ ਤੌਰ ‘ਤੇ ਅਸਹਿਣਸ਼ੀਲਤਾ ਖਿਲਾਫ ਅਵਾਰਡ ਵਾਪਸੀ ਦੀ ਚੱਲੀ ਬੇਮਿਸਾਲ ਕੌਮੀ ਮੁਹਿੰਮ ਨੂੰ “ਸੰਵਿਧਾਨ ਦਾ ਅਪਮਾਨ” ਕਰਾਰ ਦੇ ਚੁਕੇ ਹਨ ਤੇ ਉਹਨਾਂ “ਵਿਕਾਸ” ਦੇ ਅਜੰਡੇ ਤੇ ਫੋਕਸ ਕਰਨ ਦਾ ਮਸ਼ਵਰਾ ਦਿਤਾ ਸੀ। ਅਸਹਿਣਸ਼ੀਲਤਾ ਬਾਰੇ ਬਹਿਸ ‘ਚ ਸ਼੍ਰੀ ਚੌਧਰੀ ਸ਼ਾਮਲ ਰਹੇ ਹਨ ਜਿਸ ਵਿਚ ਸ਼੍ਰੀ ਮਤੀ ਰਾਇ ਨੇ ਡਟਕੇ ਅਵਾਰਡ ਵਾਪਸੀ ਮੁਹਿੰਮ ਦਾ ਸਮਰਥਣ ਕੀਤਾ ਸੀ। ਨਕਾਬਪੋਸ਼ ਹਤਿਆਰਿਆਂ, ਜਰਾਇਮ-ਪੇਸ਼ਾ ਸਿਆਸਤਦਾਨਾਂ ਤੇ ਵਧੀਕੀਆਂ ਕਰਨ ਵਾਲੀ ਪੁਲੀਸ ਵਲੋਂ ਕਲਮਕਾਰਾਂ ਨੂੰ ਖਾਮੋਸ਼ ਕਰਨ ਦੇ ਮਹੌਲ ਵਿਚ ਅਦਾਲਤ ਦਾ ਅਜਿਹਾ ਰੁਖ – ਅਸਹਿਣਸ਼ੀਲਤਾ ਦੇ ਖਤਰੇ ਬਾਰੇ ਸਰੋਕਾਰ ਦੀ ਅਹਿਮ ਪੁਸ਼ਟੀ ਹੈ।

ਅਰੁੰਧਤੀ ਰਾਇ ਮਜ਼ਲੂਮਾਂ ਦੇ ਹੱਕ ‘ਚ ਅਤੇ ਸਥਾਪਤੀ ਦੇ ਖਿਲਾਫ ਬੁਲੰਦ ਅਵਾਜ ਦਾ ਅਤੇ ਪ੍ਰਗਟਾਵੇ ਦੀ ਹੱਕ-ਜਤਲਾਈ ਦਾ ਉਭਰਵਾਂ ਪ੍ਰਤੀਕ ਬਣ ਚੁੱਕੀ ਹੈ। “ਬੇਅਵਾਜਿਆਂ ਦੀ ਅਵਾਜ਼” ਦੀ ਨਾਇਕਾ ਨੇ ਜਨ-ਸਰੋਕਾਰਾਂ ਤੋਂ ਬੋਲੀ ਹੋ ਚੁੱਕੀ ਨਿਆਂ ਵਿਵਸਥਾ ਸਾਹਮਣੇ ਇਸ ਇਤਿਹਾਸਕ ਸੁਣਵਾਈ ਲਈ 25 ਜਨਵਰੀ 2016 ਨੂੰ ਪੇਸ਼ ਹੋਣਾ ਹੈ। ਇਹ ਸੁਣਵਾਈ ਨਾਗਪੁਰ ‘ਚ ਹੋਣੀ ਹੈ ਜੋ ਇਤਫਾਕਨ ਆਰ.ਐਸ.ਐਸ ਦਾ ਹੈਡ-ਕੁਆਟਰ ਵੀ ਹੈ। ਇਸ ਅਵਾਜ ਨੂੰ ਤੁਰੰਤ ਤੇ ਅਸਰਦਾਰ ਜਨਤਕ ਪਰਤੌਅ ਦੇਣ ਦੀ ਲੋੜ ਹੈ।

[ਬੁੱਕਰ ਇਨਾਮ ਜੇਤੂ ਲੇਖਕਾ ਅਰੁੰਧਤੀ ਰਾਏ ਨੇ ਨਾਗਪੁਰ ਜੇਲ੍ਹ ਦੇ ਅੰਡਾ ਸੈੱਲ ਵਿਚ ਡੱਕੇ ਪ੍ਰੋਫੈਸਰ ਜੀ.ਐੱਨ. ਸਾਈਬਾਬਾ ਦੇ ਸਮੁੱਚੇ ਕੇਸ ਨੂੱ ਲੈ ਕੇ ਮਈ 2015 ਵਿਚ ਹਫ਼ਤਾਵਾਰ ਅੰਗਰੇਜ਼ੀ ਰਸਾਲੇ ਆਊਟਲੁੱਕ ਵਿਚ ਇਕ ਲੇਖ ਲਿਖਿਅਾ ਸੀ। ਜਿਸ ਵਿਚ ਉਨ੍ਹਾਂ ਨੇ ਜਿਥੇ ਸਾਈਬਾਬਾ ਦੀ ਆਵਾਜ਼ ਨੂੰ ਬੰਦ ਕਰਨ ਲਈ ਦਿੱਲੀ ਤੇ ਇਸ ਦੀ ਯੂਨੀਵਰਸਿਟੀ ਤਕ ਫੈਲ ਚੁੱਕੇ ਅਪਰੇਸ਼ਨ ਗਰੀਨ ਹੰਟ ਦਾ ਪਰਦਾਫਾਸ਼ ਕੀਤਾ ਉਥੇ ਨਾਲ ਹੀ ਭਾਰਤ ਦੇ ਨਿਆਂ ਪ੍ਰਬੰਧ ਦੇ ਦੂਹਰੇ ਮਿਆਰਾਂ ਨੂੰ ਵੀ ਸਾਹਮਣੇ ਲਿਆਂਦਾ। ਸਾਈਬਾਬਾ ਦੀ ਜ਼ਮਾਨਤ ਨੂੰ ਕੈਂਸਲ ਕਰਦੇ ਵਕਤ ਬੰਬੇ ਹਾਈਕੋਰਟ ਦੇ ਨਾਗਪੁਰ ਬੈਂਚ ਨੇ ਅਰੁੰਧਤੀ ਰਾਏ ਦੇ ਇਸ ਲੇਖ ਨੂੰ ਲੈ ਕੇ ਸਖ਼ਤ ਕਿਸਮ ਦੀਆਂ ਟਿੱਪਣੀਆਂ ਕੀਤੀਆਂ ਹਨ। ਜੋ ਜੁਡੀਸ਼ਰੀ ਦੇ ਕਈ ਜੱਜਾਂ ਦੇ ਰਵੱਈਏ ਦੀ ਟਿਪੀਕਲ ਮਿਸਾਲ ਹਨ। ਜਸਟਿਸ ਅਰੁਣ ਚੌਧਰੀ ਨੇ ਬੌਧਿਕ ਆਜ਼ਾਦੀ ਨੁੰ ਹੀ ਜੁਰਮ ਕਰਾਰ ਦੇ ਦਿੱਤਾ ਹੈ। ਉਸ ਦੇ ਅਨੁਸਾਰ ਜੋ ਭਾਰਤੀ ਰਾਜ ਤੇ ਇਸ ਦੀਆਂ ਸੁਰੱਖਿਆ ਤਾਕਤਾਂ ਵਲੋਂ ਮਾਓਵਾਦੀ ਲਹਿਰ ਨੂੰ ਕੁਚਲਣ ਲਈ ਲੜੀ ਜਾ ਰਹੀ ਲੜਾਈ ਦਾ ਵਿਰੋਧ ਕਰਦਾ ਹੈ ਉਹ ਆਪਣੀ ਬੌਧਿਕ ਕਾਬਲੀਅਤ ਦੀ ਦੁਰਵਰਤੋਂ ਕਰ ਰਿਹਾ ਹੈ। ਜਾਣਕਾਰੀ ਲਈ ਅਰੁੰਧਤੀ ਰਾਏ ਦਾ ਮੂਲ ਲੇਖ ਅਤੇ ਅਦਾਲਤੀ ਫ਼ੈਸਲਾ ਪਾਠਕਾਂ ਦੀ ਨਜ਼ਰ ਕੀਤਾ ਜਾ ਰਿਹਾ ਹੈ। ]

ਦਿੱਲੀ ਯੂਨੀਵਰਸਿਟੀ ਦੇ ਰਾਮਲਾਲ ਆਨੰਦ ਕਾਲਜ ਵਿਚ ਅੰਗਰੇਜ਼ੀ ਦੇ ਲੈਕਚਰਾਰ, ਡਾ. ਜੀ.ਐੱਨ. ਸਾਈਬਾਬਾ ਨੂੰ ਕੰਮ ਤੋਂ ਘਰ ਮੁੜਦੇ ਸਮੇਂ ਅਣਪਛਾਤੇ ਲੋਕਾਂ ਵਲੋਂ ਅਗਵਾ ਕਰ ਲਏ ਜਾਣ ਨੂੰ 9 ਮਈ 2015 ਨੂੰ ਇਕ ਵਰ੍ਹਾ ਹੋ ਜਾਵੇਗਾ। ਜਦੋਂ ਪਤੀ ਲਾਪਤਾ ਹੋ ਗਿਆ ਅਤੇ ਉਸ ਦਾ ਫ਼ੋਨ ਨਹੀਂ ਸੀ ਲੱਗ ਰਿਹਾ ਤਾਂ ਡਾ. ਸਾਈਬਾਬਾ ਦੀ ਪਤਨੀ ਵਸੰਤਾ ਨੇ ਮੁਕਾਮੀ ਥਾਣੇ ਵਿਚ ਗੁੰਮਸ਼ੁਦਗੀ ਦੀ ਰਿਪੋਰਟ ਦਰਜ ਕਰਾਈ। ਅੱਗੇ ਚੱਲਕੇ ਉਨ੍ਹਾਂ ਅਣਪਛਾਤੇ ਅਗਵਾਕਾਰਾਂ ਨੇ ਆਪਣੀ ਸ਼ਨਾਖ਼ਤ ਮਹਾਰਾਸ਼ਟਰ ਪੁਲਿਸ ਵਜੋਂ ਕਰਵਾਈ ਅਤੇ ਦੱਸਿਆ ਕਿ ਉਹ ਅਗਵਾ ਇਕ ਗ੍ਰਿਫ਼ਤਾਰੀ ਸੀ।ਆਖ਼ਿਰ ਉਸ ਨੂੰ ਇੰਞ ਅਗਵਾ ਕਿਉਂ ਕਰਨਾ ਪਿਆ, ਜਦਕਿ ਉਹ ਉਸ ਨੂੰ ਰਸਮੀ ਤੌਰ 'ਤੇ ਵੀ ਗ੍ਰਿਫ਼ਤਾਰ ਕਰ ਸਕਦੇ ਸਨ? ਉਸ ਪ੍ਰੋਫੈਸਰ ਨੂੰ ਜੋ ਵੀਲ੍ਹ ਚੇਅਰ ਉਪਰ ਹੀ ਚਲਦਾ ਹੈ ਕਿਉਂਕਿ ਜਦੋਂ ਉਹ ਪੰਜ ਸਾਲ ਦਾ ਸੀ ਓਦੋਂ ਤੋਂ ਹੀ ਉਸਦਾ ਲੱਕ ਤੋਂ ਹੇਠਲਾ ਹਿੱਸਾ ਨਕਾਰਾ ਹੈ। ਇਸ ਦੇ ਕਾਰਨ ਦੋ ਹਨ: ਪਹਿਲਾ ਉਹ ਆਪਣੀਆਂ ਪਹਿਲੀਆਂ ਫੇਰੀਆਂ ਤੋਂ ਜਾਣਦੇ ਸੀ ਕਿ ਜੇ ਉਹ ਦਿੱਲੀ ਯੂਨੀਵਰਸਿਟੀ ਵਿਚ ਉਸ ਦੇ ਘਰੋਂ ਉਸ ਨੂੰ ਚੁੱਕਣਗੇ ਤਾਂ ਉਨ੍ਹਾਂ ਨੂੰ ਗੁੱਸੇ ਨਾਲ ਭਰੇ ਲੋਕਾਂ ਦੇ ਹਜ਼ੂਮ ਦਾ ਸਾਹਮਣਾ ਕਰਨਾ ਪਵੇਗਾ -ਉਹ ਪ੍ਰੋਫੈਸਰ, ਕਾਰਕੁੰਨ ਅਤੇ ਵਿਦਿਆਰਥੀ ਜੋ ਪ੍ਰੋਫੈਸਰ ਸਾਈਬਾਬਾ ਨਾਲ ਪਿਆਰ ਕਰਦੇ ਹਨ ਅਤੇ ਉਸ ਨੂੰ ਪਸੰਦ ਕਰਦੇ ਹਨ, ਸਿਰਫ਼ ਇਸ ਲਈ ਨਹੀਂ ਕਿ ਉਹ ਇਕ ਸਮਰਪਿਤ ਅਧਿਆਪਕ ਹੈ, ਸਗੋਂ ਇਕ ਦੀ ਇਕ ਵਜ੍ਹਾ ਦੁਨੀਆ ਦੇ ਬਾਰੇ ਵਿਚ ਉਸ ਦਾ ਬੇਖ਼ੌਫ਼ ਸਿਆਸੀ ਨਜ਼ਰੀਆ ਵੀ ਹੈ। ਦੂਜਾ, ਅਗਵਾ ਕਰਨ ਨਾਲ ਇਹ ਪ੍ਰਭਾਵ ਬਣੇਗਾ ਜਿਵੇਂ ਮਹਿਜ਼ ਆਪਣੀ ਮੁਸਤੈਦੀ ਅਤੇ ਦਲੇਰੀ ਨਾਲ ਹੀ ਉਨ੍ਹਾਂ ਨੇ ਇਕ ਖ਼ਤਰਨਾਕ ਦਹਿਸ਼ਤਗਰਦ ਦਾ ਸੁਰਾਗ਼ ਲਾਕੇ ਉਸ ਨੂੰ ਦਬੋਚ ਲਿਆ ਹੋਵੇ। ਹਾਲਾਂਕਿ ਸਚਾਈ ਕਿਤੇ ਜ਼ਿਆਦਾ ਨੀਰਸ ਹੈ। ਸਾਡੇ ਵਿੱਚੋਂ ਅਨੇਕ ਲੋਕਾਂ ਨੂੰ ਲੰਮੇ ਸਮੇਂ ਤੋਂ ਖ਼ਦਸ਼ਾ ਸੀ ਕਿ ਪ੍ਰੋਫੈਸਰ ਸਾਈਬਾਬਾ ਨੂੰ ਗ੍ਰਿਫ਼ਤਾਰ ਕਰ ਲਿਆ ਜਾਵੇਗਾ। ਕਈ ਮਹੀਨਿਆਂ ਤੋਂ ਇਹ ਆਮ ਚਰਚਾ ਸੀ। ਇਨ੍ਹਾਂ ਮਹੀਨਿਆਂ ਵਿਚ ਕਦੇ ਵੀ, ਅਗਵਾ ਕੀਤੇ ਜਾਣ ਦੇ ਦਿਨ ਤਕ ਵੀ ਉਸ ਦੇ ਜਾਂ ਕਿਸੇ ਹੋਰ ਦੇ ਇਹ ਖ਼ਿਆਲ ਵਿਚ ਨਹੀਂ ਆਇਆ ਕਿ ਇਸ ਦਾ ਸਾਹਮਣਾ ਕਰਨ ਦੀ ਬਜਾਏ ਉਹ ਕੁਛ ਹੋਰ ਕਰੇ। ਦਰ ਅਸਲ, ਇਸ ਦੌਰਾਨ ਉਸ ਨੇ ਜ਼ਿਆਦਾ ਮਿਹਨਤ ਕੀਤੀ ਅਤੇ ਪਾਲਿਟਿਕਸ ਆਫ ਦ ਡਿਸਿਪਲਿਨ ਆਫ ਇੰਡੀਅਨ ਇੰਗਲਿਸ਼ ਰਾਈਟਿੰਗ (ਹਿੰਦੁਸਤਾਨੀ ਅੰਗਰੇਜ਼ੀ ਲੇਖਣੀ ਵਿਚ ਅਨੁਸ਼ਾਸਨ ਦੀ ਸਿਆਸਤ) ਉਪਰ ਆਪਣਾ ਪੀਐੱਚ. ਡੀ. ਦਾ ਕੰਮ ਨੇਪਰੇ ਚਾੜ੍ਹਿਆ।ਸਾਨੂੰ ਕਿਉਂ ਲੱਗਿਆ ਸੀ ਕਿ ਉਸ ਨੂੰ ਗ੍ਰਿਫ਼ਤਾਰ ਕਰ ਲਿਆ ਜਾਵੇਗਾ? ਉਸ ਦਾ ਜੁਰਮ ਕੀ ਸੀ?ਸਤੰਬਰ 2009 'ਚ, ਤੱਤਕਾਲੀ ਗ੍ਰਹਿ ਮੰਤਰੀ ਪੀ. ਚਿਦੰਬਰਮ ਨੇ ਲਾਲ ਲਾਂਘੇ (ਰੈੱਡ ਕਾਰੀਡੋਰ) ਵਜੋਂ ਜਾਣੇ ਜਾਂਦੇ ਇਲਾਕੇ ਵਿਚ, ਆਪਰੇਸ਼ਨ ਗ੍ਰੀਨ ਹੰਟ ਨਾਂ ਦੀ ਜੰਗ ਦਾ ਐਲਾਨ ਕੀਤਾ ਸੀ। ਇਹ ਕਿਹਾ ਗਿਆ ਕਿ ਇਹ ਮੱਧ ਭਾਰਤ ਦੇ ਜੰਗਲਾਂ ਵਿਚ ਮਾਓਵਾਦੀ 'ਦਹਿਸ਼ਤਗਰਦਾਂ' ਦੇ ਖ਼ਿਲਾਫ਼ ਨੀਮ-ਫ਼ੌਜੀ ਬਲਾਂ ਦੀ ਸਫ਼ਾਇਆ ਮੁਹਿੰਮ ਹੈ। ਦਰ ਅਸਲ, ਇਹ ਉਸ ਲੜਾਈ ਦਾ ਸਰਕਾਰੀ ਨਾਂ ਸੀ, ਜੋ ਰਾਜ ਦੇ ਬਣਾਏ ਕਾਤਲ ਗਰੋਹਾਂ (ਬਸਤਰ ਵਿਚ ਸਲਵਾ ਜੁਡਮ ਅਤੇ ਹੋਰ ਸੂਬਿਆਂ ਵਿਚ ਬੇਨਾਮ) ਵਲੋਂ ਦੁਸ਼ਮਣ ਦੇ ਕੰਮ ਆਉਣ ਵਾਲੀ ਹਰ ਚੀਜ਼ ਨੂੰ ਤਬਾਹ ਕਰਨ ਦੀ ਲੜਾਈ ਰਹੀ ਹੈ। ਉਨ੍ਹਾਂ ਨੂੰ ਦਿੱਤਾ ਗਿਆ ਹੁਕਮ, ਜੰਗਲ ਨੂੰ ਇਸ ਦੇ ਖ਼ਰੂਦੀ ਬਾਸ਼ਿੰਦਿਆਂ ਤੋਂ ਖਾਲੀ ਕਰਾਉਣ ਦਾ ਸੀ, ਤਾਂ ਕਿ ਖਾਣਾਂ ਅਤੇ ਬੁਨਿਆਦੀ ਢਾਂਚੇ ਦੀ ਉਸਾਰੀ ਦੇ ਕੰਮਾਂ ਵਿਚ ਲੱਗੀਆਂ ਕਾਰਪੋਰੇਸ਼ਨ ਆਪਣੇ ਰੁਕੇ ਹੋਏ ਪ੍ਰੋਜੈਕਟਾਂ ਨੂੰ ਅੱਗੇ ਵਧਾ ਸਕਣ। ਇਸ ਤੱਥ ਨਾਲ ਓਦੋਂ ਦੀ ਯੂ.ਪੀ.ਏ. ਹਕੂਮਤ ਨੂੰ ਕੋਈ ਪ੍ਰੇਸ਼ਾਨੀ ਹੋਈ ਕਿ ਆਦਿਵਾਸੀ ਜ਼ਮੀਨ ਨੂੰ ਨਿੱਜੀ ਕੰਪਨੀਆਂ ਦੇ ਹੱਥ ਵੇਚਣਾ ਗ਼ੈਰਕਾਨੂੰਨੀ ਅਤੇ ਗ਼ੈਰਸੰਵਿਧਾਨਕ ਹੈ। (ਮੌਜੂਦਾ ਹਕੂਮਤ ਦਾ ਨਵਾਂ ਭੋਂਇ ਗ੍ਰਹਿਣ ਬਿੱਲ ਉਸ ਗ਼ੈਰ-ਕਾਨੂੰਨੀ ਨੂੰ ਕਾਨੂੰਨੀ ਵਿਚ ਬਦਲਣ ਦੀ ਤਜਵੀਜ਼ ਹੀ ਹੈ।) ਕਾਤਲ ਗਰੋਹਾਂ ਦੇ ਨਾਲ-ਨਾਲ ਹਜ਼ਾਰਾਂ ਨੀਮ-ਫ਼ੌਜੀ ਤਾਕਤਾਂ ਨੇ ਹਮਲਾ ਕੀਤਾ, ਪਿੰਡ ਸਾੜੇ, ਪੇਂਡੂਆਂ ਦੇ ਕਤਲ ਕੀਤੇ ਅਤੇ ਔਰਤਾਂ ਨਾਲ ਜਬਰ-ਜਨਾਹ ਕੀਤੇ। ਦਹਿ-ਹਜ਼ਾਰਾਂ ਆਦਿਵਾਸੀਆਂ ਨੂੰ ਆਪਣੇ ਘਰ-ਬਾਰ ਛੱਡਕੇ ਜੰਗਲਾਂ ਵਿਚ ਖੁੱਲ੍ਹੇ ਆਸਮਾਨ ਹੇਠ ਪਨਾਹ ਲੈਣ ਲਈ ਮਜਬੂਰ ਕੀਤਾ ਗਿਆ। ਇਸ ਬੇਰਹਿਮੀ ਦੇ ਖ਼ਿਲਾਫ਼ ਜਵਾਬੀ ਕਾਰਵਾਈ ਕਰਦੇ ਹੋਏ ਸੈਂਕੜੇ ਸਥਾਨਕ ਲੋਕ ਲੋਕ-ਮੁਕਤੀ ਛਾਪਾਮਾਰ ਫ਼ੌਜ ਵਿਚ ਜਾ ਰਲੇ, ਜੋ ਸੀ.ਪੀ.ਆਈ. (ਮਾਓਵਾਦੀ) ਨੇ ਬਣਾਈ ਹੈ। ਇਹ ਉਹ ਪਾਰਟੀ ਹੈ, ਜਿਸ ਨੂੰ ਸਾਬਕਾ ਪ੍ਰਧਾਨ ਮੰਤਰੀ ਮਨਮੋਹਣ ਸਿੰਘ ਨੇ ਆਪਣੇ ਮਸ਼ਹੂਰ ਕਥਨ ਵਿਚ ਹਿੰਦੁਸਤਾਨ ਦੀ 'ਅੰਦਰੂਨੀ ਸੁਰੱਖਿਆ ਲਈ ਇੱਕੋ-ਇਕ ਸਭ ਤੋਂ ਵੱਡਾ ਖ਼ਤਰਾ' ਦੱਸਿਆ ਸੀ। ਹੁਣ ਵੀ, ਇਸ ਸਮੁੱਚੇ ਇਲਾਕੇ ਵਿਚ ਜੋ ਉਥਲ-ਪੁੱਥਲ ਦੀ ਹਾਲਤ ਹੈ, ਉਸ ਨੂੰ ਖ਼ਾਨਾਜੰਗੀ ਕਿਹਾ ਜਾ ਸਕਦਾ ਹੈ।ਜਿਵੇਂ ਕਿ ਕਿਸੇ ਵੀ ਲੰਮੇ ਲੋਕ-ਯੁੱਧ ਵਿਚ ਹੁੰਦਾ ਹੈ, ਹਾਲਾਤ ਸਿੱਧੇ-ਸਰਲ ਹੋਣ ਤੋਂ ਕਿਤੇ ਦੂਰ ਹਨ। ਟਾਕਰੇ ਵਿਚ ਜਿਥੇ ਕੁਛ ਲੋਕਾਂ ਨੇ ਚੰਗੀ ਲੜਾਈ ਲੜਨੀ ਜਾਰੀ ਰੱਖੀ ਹੈ, ਕੁਛ ਹੋਰ ਲੋਕ ਮੌਕਾਪ੍ਰਸਤ, ਰੰਗਦਾਰੀ ਵਸੂਲਣ ਵਾਲੇ ਅਤੇ ਮਾਮੂਲੀ ਮੁਜਰਿਮ ਬਣ ਚੁੱਕੇ ਹਨ। ਦੋਵਾਂ ਸਮੂਹਾਂ ਵਿਚ ਫ਼ਰਕ ਕਰ ਸਕਣਾ ਹਮੇਸ਼ਾ ਆਸਾਨ ਨਹੀਂ ਹੁੰਦਾ, ਅਤੇ ਇਹ ਉਨ੍ਹਾਂ ਨੂੰ ਇਕ ਹੀ ਰੰਗ ਵਿਚ ਪੇਸ਼ ਕੀਤੇ ਜਾਣ ਨੂੰ ਸੁਖਾਲਾ ਬਣਾ ਦਿੰਦਾ ਹੈ। ਜਬਰ ਦੀਆਂ ਖ਼ੌਫ਼ਨਾਕ ਘਟਨਾਵਾਂ ਹੋਈਆਂ ਹਨ। ਇਕ ਤਰ੍ਹਾਂ ਦੇ ਜਬਰ ਨੂੰ ਦਹਿਸ਼ਤਗਰਦੀ ਕਿਹਾ ਜਾਂਦਾ ਹੈ ਅਤੇ ਦੂਜੇ ਨੂੰ ਤਰੱਕੀ।2010 ਅਤੇ 2011 ਵਿਚ, ਜਦੋਂ ਅਪਰੇਸ਼ਨ ਗ੍ਰੀਨ ਹੰਟ ਦਾ ਸਭ ਤੋਂ ਬੇਰਹਿਮ ਦੌਰ  ਸੀ, ਇਸ ਦੇ ਖ਼ਿਲਾਫ਼ ਮੁਹਿੰਮ ਵਿਚ ਤੇਜ਼ੀ ਆਈ, ਕਈ ਸ਼ਹਿਰਾਂ ਵਿਚ ਜਨਤਕ ਇਕੱਠ ਅਤੇ ਰੈਲੀਆਂ ਹੋਈਆਂ। ਜਿਉਂ ਜਿਉਂ ਜੰਗਲ ਵਿਚ ਹੋਣ ਵਾਲੀਆਂ ਘਟਨਾਵਾਂ ਦੀ ਖ਼ਬਰ ਫੈਲਣ ਲੱਗੀ, ਕੌਮਾਂਤਰੀ ਮੀਡੀਆ ਨੇ ਇਸ ਵੱਲ ਧਿਆਨ ਦੇਣਾ ਸ਼ੁਰੂ ਕੀਤਾ। ਡਾ. ਜੀ.ਐੱਨ. ਸਾਈਬਾਬਾ ਉਨ੍ਹਾਂ ਮੁੱਖ ਲੋਕਾਂ ਵਿੱਚੋਂ ਇਕ ਸਨ, ਜਿਨ੍ਹਾਂ ਨੇ ਅਪਰੇਸ਼ਨ ਗ੍ਰੀਨ ਹੰਟ ਦੇ ਖ਼ਿਲਾਫ਼ ਇਕ ਜਨਤਕ ਅਤੇ ਪੂਰੀ ਤਰ੍ਹਾਂ ਨਾਲ ਖੁੱਲ੍ਹੀ ਮੁਹਿੰਮ ਲਾਮਬੰਦ ਕੀਤੀ ਸੀ। ਘੱਟੋਘੱਟ ਆਰਜੀ ਤੌਰ 'ਤੇ ਹੀ, ਉਹ ਮੁਹਿੰਮ ਕਾਮਯਾਬ ਹੋਈ ਸੀ। ਸ਼ਰਮਿੰਦਗੀ ਨਾਲ ਹਕੂਮਤ ਨੂੰ ਇਹ ਢੌਂਗ ਰਚਣਾ ਪਿਆ ਕਿ ਅਪਰੇਸ਼ਨ ਗ੍ਰੀਨ ਹੰਟ ਨਾਂ ਦੀ ਕੋਈ ਸ਼ੈਅ ਨਹੀਂ ਹੈ, ਕਿ ਇਹ ਮਹਿਜ਼ ਮੀਡੀਆ ਦੀ ਬਣਾਈ ਹੋਈ ਗੱਲ ਹੈ। (ਬੇਸ਼ੱਕ ਆਦਿਵਾਸੀ ਜ਼ਮੀਨ ਉਪਰ ਹਮਲਾ ਜਾਰੀ ਹੈ, ਜਿਸ ਦੇ ਬਾਰੇ ਜ਼ਿਆਦਾਤਰ ਕੋਈ ਖ਼ਬਰ ਨਹੀਂ ਆਉਂਦੀ, ਕਿਉਂਕਿ ਹੁਣ ਇਹ ਇਕ ਬੇਨਾਮ ਅਪਰੇਸ਼ਨ ਹੈ। ਇਕ ਮਾਓਵਾਦੀ ਹਮਲੇ ਵਿਚ ਮਾਰੇ ਗਏ ਸਲਵਾ ਜੁਡਮ ਦੇ ਬਾਨੀ ਮਹਿੰਦਰ ਕਰਮਾ ਦੇ ਪੁੱਤਰ ਸ਼ਵਿੰਦਰ ਕਰਮਾ ਨੇ ਇਸ ਹਫ਼ਤੇ ਪੰਜ ਮਈ 2015 ਨੂੰ ਸਲਵਾ ਜੁਡਮ-2 ਦੀ ਸ਼ੁਰੂਆਤ ਦਾ ਐਲਾਨ ਕੀਤਾ ਹੈ। ਇਹ ਸੁਪਰੀਮ ਕੋਰਟ ਦੇ ਉਸ ਫ਼ੈਸਲੇ ਦੇ ਬਾਵਜੂਦ ਕੀਤਾ ਗਿਆ, ਜਿਸ ਵਿਚ ਅਦਾਲਤ ਨੇ ਸਲਵਾ ਜੁਡਮ-1 ਨੂੰ ਗ਼ੈਰਕਾਨੂੰਨੀ ਤੇ ਗ਼ੈਰਸੰਵਿਧਾਨਕ ਐਲਾਨਿਆ ਸੀ ਅਤੇ ਇਸ ਨੂੰ ਬੰਦ ਕਰਨ ਦਾ ਆਦੇਸ਼ ਦਿੱਤਾ ਸੀ।)ਅਪਰੇਸ਼ਨ ਬੇਨਾਮ ਵਿਚ, ਜਿਹੜਾ ਕੋਈ ਵੀ ਰਾਜ ਦੀ ਨੀਤੀ ਦੀ ਆਲੋਚਨਾ ਕਰਦਾ ਹੈ, ਜਾਂ ਉਸ ਨੂੰ ਲਾਗੂ ਕਰਨ ਵਿਚ ਅੜਿੱਕਾ ਖੜ੍ਹਾ ਕਰਦਾ ਹੈ ਉਸ ਨੂੰ ਮਾਓਵਾਦੀ ਕਿਹਾ ਜਾਂਦਾ ਹੈ। ਇਸ ਤਰ੍ਹਾਂ ਮਾਓਵਾਦੀ ਕਰਾਰ ਦਿੱਤੇ ਗਏ ਹਜ਼ਾਰਾਂ ਦਲਿਤ ਅਤੇ ਆਦਿਵਾਸੀ, ਦੇਸ਼ਧ੍ਰੋਹ ਅਤੇ ਰਾਜ ਦੇ ਖ਼ਿਲਾਫ਼ ਜੰਗ ਛੇੜਨ ਵਰਗੇ ਜੁਰਮਾਂ ਦੇ ਬੇਸਿਰ-ਪੈਰ ਇਲਜ਼ਾਮਾਂ ਨਾਲ ਗ਼ੈਰਕਾਨੂੰਨੀ ਕਾਰਵਾਈਆਂ ਰੋਕੂ ਕਾਨੂੰਨ (ਯੂ.ਏ.ਪੀ.ਏ.) ਦੇ ਤਹਿਤ ਜੇਲ੍ਹ ਵਿਚ ਬੰਦ ਹਨ। ਯੂ.ਏ.ਪੀ.ਏ. ਇਕ ਐਸਾ ਕਾਨੂੰਨ ਹੈ ਕਿ ਜੇ ਮਹਿਜ਼ ਇਸ ਨੂੰ ਵਰਤੋਂ ਵਿਚ ਲਿਆਂਦਾ ਜਾਣਾ ਐਨਾ ਤ੍ਰਾਸਦਿਕ ਨਾ ਹੁੰਦਾ, ਤਾਂ ਇਸ ਨੂੰ ਦੇਖਕੇ ਕਿਸੇ ਵੀ ਸਮਝਦਾਰ ਇਨਸਾਨ ਦਾ ਹਾਸਾ ਬੰਦ ਨਹੀਂ ਸੀ ਹੋਣਾ। ਇਕ ਪਾਸੇ, ਜਦੋਂ ਪਿੰਡ ਵਾਲੇ ਕਾਨੂੰਨੀ ਮਦਦ ਅਤੇ ਇਨਸਾਫ਼ ਦੀ ਉਮੀਦ ਤੋਂ ਬਿਨਾ ਵਰ੍ਹਿਆਂ ਤਕ ਜੇਲ੍ਹ ਵਿਚ ਸੜਦੇ ਰਹਿੰਦੇ ਹਨ, ਅਕਸਰ ਹੀ ਉਨ੍ਹਾਂ ਨੂੰ ਇਹ ਵੀ ਪਤਾ ਨਹੀਂ ਹੁੰਦਾ ਕਿ ਉਨ੍ਹਾਂ ਉਪਰ ਕਿਸ ਜੁਰਮ ਦਾ ਇਲਜ਼ਾਮ ਹੈ, ਦੂਜੇ ਪਾਸੇ ਹੁਣ ਹਕੂਮਤ ਨੇ ਆਪਣੀ ਨਜ਼ਰ ਸ਼ਹਿਰਾਂ ਵਿਚ ਉਨ੍ਹਾਂ ਵੱਲ ਮੋੜ ਲਈ ਹੈ, ਜਿਸ ਨੂੰ ਇਹ 'ਓਜੀਡਬਲਯੂ' ਭਾਵ ਖੁੱਲ੍ਹੇਆਮ ਕੰਮ ਕਰਨ ਵਾਲੇ ਕਾਰਕੁੰਨ (ਓਵਰਗ੍ਰਾਊਂਡ ਵਰਕਰ) ਕਹਿੰਦੀ ਹੈ।ਗ੍ਰਹਿ ਮੰਤਰਾਲੇ ਨੇ 2013 ਵਿਚ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿਚ ਦਾਖ਼ਿਲ ਆਪਣੇ ਹਲਫ਼ਨਾਮੇ ਵਿਚ ਆਪਣੇ ਇਰਾਦੇ ਸਾਫ਼-ਸਾਫ਼ ਜ਼ਾਹਿਰ ਕੀਤੇ ਸਨ। ਉਸ ਵਿਚ ਕਿਹਾ ਗਿਆ ਸੀ: 'ਕਸਬਿਆਂ ਤੇ ਸ਼ਹਿਰਾਂ ਵਿਚ ਸੀ.ਪੀ.ਆਈ. (ਮਾਓਵਾਦੀ) ਦੇ ਵਿਚਾਰਕਾਂ ਅਤੇ ਹਮਾਇਤੀਆਂ ਨੇ ਰਾਜ ਦਾ ਨਕਸ਼ਾ ਵਿਗਾੜਕੇ ਪੇਸ਼ ਕਰਨ ਲਈ ਜਥੇਬੰਦ ਅਤੇ ਸਿਲਸਿਲੇਵਾਰ ਪ੍ਰਚਾਰ ਵਿੱਢਿਆ ਹੋਇਆ ਹੈ.... ਇਹ ਉਹ ਵਿਚਾਰਕ ਹਨ ਜਿਨ੍ਹਾਂ ਨੇ ਮਾਓਵਾਦੀ ਲਹਿਰ ਨੂੰ ਜ਼ਿੰਦਾ ਰੱਖਿਆ ਹੋਇਆ ਹੈ ਅਤੇ ਕਈ ਪੱਖਾਂ ਤੋਂ ਤਾਂ ਇਹ ਪੀਪਲਜ਼ ਲਿਬਰੇਸ਼ਨ ਗੁਰੀਲਾ ਆਰਮੀ ਦੇ ਕਾਡਰਾਂ ਤੋਂ ਵੀ ਜ਼ਿਆਦਾ ਖ਼ਤਰਨਾਕ ਹਨ।'ਡਾ. ਸਾਈਬਾਬਾ ਹਾਜ਼ਿਰ ਹੋਜਦੋਂ ਉਸ ਦੇ ਬਾਰੇ ਵਿਚ ਸਾਫ਼ ਤੌਰ 'ਤੇ ਮਨਘੜਤ ਅਤੇ ਵਧਾ-ਚੜ੍ਹਾਕੇ ਅਨੇਕਾਂ ਖ਼ਬਰਾਂ ਛਪਣ ਲੱਗੀਆਂ, ਓਦੋਂ ਸਾਨੂੰ ਪਤਾ ਚਲ ਗਿਆ ਸੀ ਕਿ ਉਸ ਦੀ ਨਿਸ਼ਾਨਦੇਹੀ ਕੀਤੀ ਜਾ ਚੁੱਕੀ ਹੈ। (ਜਿਥੇ ਉਨ੍ਹਾਂ ਦੇ ਕੋਲ ਅਸਲੀ ਸਬੂਤ ਨਹੀਂ ਸਨ, ਉਨ੍ਹਾਂ ਦੇ ਕੋਲ ਅਜ਼ਮਾਇਆ ਹੋਇਆ ਇਕ ਹੋਰ ਸਭ ਤੋਂ ਬਿਹਤਰ ਤਰੀਕਾ ਸੀ। ਉਹ ਇਹ ਕਿ ਆਪਣੇ ਸ਼ਿਕਾਰ ਦੇ ਬਾਰੇ ਸ਼ੱਕੀ ਮਾਹੌਲ ਬਣਾ ਦਿਓ।)12 ਸਤੰਬਰ 2013 ਨੂੰ ਉਸ ਦੇ ਘਰ ਪੰਜਾਹ ਪੁਲਸੀਆਂ ਨੇ ਛਾਪਾ ਮਾਰਿਆ। ਉਨ੍ਹਾਂ ਕੋਲ ਮਹਾਰਾਸ਼ਟਰ ਦੇ ਇਕ ਨਿੱਕੇ ਜਹੇ ਸ਼ਹਿਰ ਅਹੇਰੀ ਦੇ ਮੈਜਿਸਟਰੇਟ ਵਲੋਂ ਚੋਰੀ ਕੀਤਾ ਸਮਾਨ ਬਰਾਮਦ ਕਰਨ ਲਈ ਜਾਰੀ ਕੀਤੇ ਤਲਾਸ਼ੀ ਵਾਰੰਟ ਸਨ। ਚੋਰੀ ਦਾ ਕੋਈ ਸਮਾਨ ਤਾਂ ਉਨ੍ਹਾਂ ਨੂੰ ਨਹੀਂ ਮਿਲਿਆ। ਸਗੋਂ ਉਹ ਉਨ੍ਹਾਂ ਦਾ ਸਮਾਨ ਚੁੱਕਕੇ (ਚੁਰਾਕੇ?) ਲੈ ਗਏ। ਉਨ੍ਹਾਂ ਦਾ ਨਿੱਜੀ ਲੈਪਟਾਪ, ਹਾਰਡ ਡਿਸਕ ਅਤੇ ਪੈਨ ਡਰਾਈਵਾਂ। ਦੋ ਹਫ਼ਤੇ ਪਿੱਛੋਂ ਮਾਮਲੇ ਦੇ ਤਫ਼ਤੀਸ਼ੀ ਅਧਿਕਾਰੀ ਸੁਹਾਸ ਬਵਾਚੇ ਨੇ ਡਾ. ਸਾਈਬਾਬਾ ਨੂੰ ਫ਼ੋਨ ਕੀਤਾ ਅਤੇ ਹਾਰਡ ਡਿਸਕ ਖੋਲ੍ਹਣ ਲਈ ਉਸ ਤੋਂ ਪਾਸਵਰਡ ਪੁੱਛੇ। ਡਾ. ਸਾਈਬਾਬਾ ਨੇ ਉਨ੍ਹਾਂ ਨੂੰ ਪਾਸਵਰਡ ਦੱਸ ਦਿੱਤੇ। 9 ਜਨਵਰੀ 2014 ਨੂੰ ਪੁਲਸ ਦੀ ਇਕ ਟੋਲੀ ਨੇ ਉਸ ਦੇ ਘਰ ਆ ਕੇ ਘੰਟਿਆਂ ਬੱਧੀ ਤਫ਼ਤੀਸ਼ ਕੀਤੀ। 9 ਮਈ ਨੂੰ ਉਨ੍ਹਾਂ ਨੇ ਉਸ ਨੂੰ ਅਗਵਾ ਕਰ ਲਿਆ। ਉਸੇ ਰਾਤ ਉਹ ਉਸ ਨੂੰ ਪਹਿਲਾਂ ਨਾਗਪੁਰ ਤੇ ਫਿਰ ਅਹੇਰੀ ਲੈ ਗਏ ਅਤੇ ਫਿਰ ਨਾਗਪੁਰ ਮੋੜ ਲਿਆਏ। ਸੈਂਕੜੇ ਪੁਲਸੀਆਂ, ਜੀਪਾਂ ਅਤੇ ਬਾਰੂਦੀ ਸੁਰੰਗ ਵਿਰੋਧੀ ਗੱਡੀਆਂ ਦੇ ਕਾਫ਼ਲੇ ਦੇ ਪਹਿਰੇ ਹੇਠ। ਉਸ ਨੂੰ ਨਾਗਪੁਰ ਕੇਂਦਰੀ ਜੇਲ੍ਹ ਵਿਚ, ਇਸ ਦੇ ਬਦਨਾਮ ਅੰਡਾ ਸੈੱਲ ਵਿਚ ਕੈਦ ਕੀਤਾ ਗਿਆ, ਜਿਥੇ ਉਸ ਦਾ ਨਾਂ ਸਾਡੇ ਮੁਲਕ ਦੇ ਜੇਲ੍ਹਾਂ ਵਿਚ ਡੱਕੇ, ਸੁਣਵਾਈ ਦੀ ਉਡੀਕ ਕਰ ਰਹੇ ਤਿੰਨ ਲੱਖ ਲੋਕਾਂ ਦੇ ਹਜ਼ੂਮ ਵਿਚ ਸ਼ੁਮਾਰ ਹੋ ਗਿਆ। ਹੰਗਾਮੇ ਭਰੇ ਇਸ ਪੂਰੇ ਨਾਟਕ ਦੌਰਾਨ ਉਸਦੀ ਵੀਲ੍ਹ ਚੇਅਰ ਟੁੱਟ ਗਈ। ਡਾ. ਸਾਈਬਾਬਾ ਦੀ ਜਿਸ ਤਰ੍ਹਾਂ ਦੀ ਹਾਲਤ ਹੈ, ਉਸ ਨੂੰ '90ਫ਼ੀਸਦੀ ਅਪਾਹਜ' ਕਿਹਾ ਜਾਂਦਾ ਹੈ। ਸਿਹਤ ਹੋਰ ਨਾ ਵਿਗੜੇ ਇਸ ਤੋਂ ਬਚਾਓ ਲਈ ਉਸ ਨੂੰ ਲਗਾਤਾਰ ਦੇਖਰੇਖ, ਫਿਜ਼ਿਓਥੈਰੇਪੀ ਅਤੇ ਦਵਾਈਆਂ ਦੀ ਜ਼ਰੂਰਤ ਰਹਿੰਦੀ ਹੈ। ਇਸ ਦੇ ਬਾਵਜੂਦ, ਉਸ ਨੂੰ ਇਕੱਲਤਾ ਵਾਲੀ ਕੋਠੜੀ ਵਿਚ ਸੁੱਟ ਦਿੱਤਾ ਗਿਆ (ਹੁਣ ਵੀ ਉਹ ਉਥੇ ਹੀ ਹੈ), ਜਿਥੇ ਟੱਟੀ-ਪੇਸ਼ਾਬ ਜਾਣ ਵਿਚ ਉਸ ਨੂੰ ਸਹਾਰਾ ਦੇਣ ਵਾਲਾ ਕੋਈ ਨਹੀਂ। ਉਸ ਨੂੰ ਆਪਣੇ ਹੱਥਾਂ ਤੇ ਪੈਰਾਂ ਦੇ ਸਹਾਰੇ ਰੀਂਗਣਾ ਪੈਂਦਾ ਹੈ। ਇਸ ਵਿੱਚੋਂ ਕੁਛ ਵੀ ਤਸੀਹਿਆਂ ਦੇ ਘੇਰੇ ਵਿਚ ਨਹੀਂ ਆਵੇਗਾ। ਬਿਲਕੁਲ ਨਹੀਂ। ਆਪਣੇ ਇਸ ਖ਼ਾਸ ਕੈਦੀ ਦੇ ਬਾਰੇ ਸਟੇਟ ਨੂੰ ਇਕ ਵੱਡਾ ਲਾਹਾ ਇਹ ਹੈ ਕਿ ਉਹ ਬਾਕੀ ਕੈਦੀਆਂ ਵਰਗਾ ਨਹੀਂ ਹੈ। ਉਸ ਨੂੰ ਬੇਰਹਿਮੀ ਨਾਲ ਤਸੀਹੇ ਦਿੱਤੇ ਜਾ ਸਕਦੇ ਹਨ, ਸ਼ਾਇਦ ਉਸ ਨੂੰ ਮਾਰਿਆ ਵੀ ਜਾ ਸਕਦਾ ਹੈ, ਅਤੇ ਐਸਾ ਕਰਨ ਲਈ ਕਿਸੇ ਨੂੰ ਉਸ ਉਪਰ ਉਂਗਲ ਚੁੱਕਣ ਦੀ ਵੀ ਲੋੜ ਨਹੀਂ ਹੈ।ਅਗਲੀ ਸਵੇਰ ਨਾਗਪੁਰ ਦੇ ਅਖ਼ਬਾਰਾਂ ਦੇ ਪਹਿਲੇ ਸਫ਼ੇ ਉਪਰ ਜੋ ਤਸਵੀਰਾਂ ਛਪੀਆਂ ਉਨ੍ਹਾਂ ਵਿਚ ਮਹਾਰਾਸ਼ਟਰ ਪੁਲਿਸ ਦੀ ਭਾਰੀ ਹਥਿਆਰਬੰਦ ਪਾਰਟੀ ਨੇ ਆਪਣੀ ਜਿੱਤ ਦੀ ਨਿਸ਼ਾਨੀ ਦੇ ਨਾਲ ਪੂਰੀ ਸ਼ਾਨੋ-ਸ਼ੌਕਤ ਨਾਲ ਪੋਜ਼ ਦਿੱਤੇ ਹੋਏ ਸਨ - ਆਪਣੀ ਟੁੱਟੀ ਹੋਈ ਵੀਲ੍ਹ ਚੇਅਰ ਉਪਰ ਖ਼ਤਰਨਾਕ ਦਹਿਸ਼ਤਗਰਦ, ਜੰਗੀ ਕੈਦੀ ਪ੍ਰੋਫੈਸਰ।ਉਸ ਉਪਰ ਯੂ.ਏ.ਪੀ.ਏ. ਦੇ ਇਨ੍ਹਾਂ ਸੈਕਸ਼ਨਾਂ ਤਹਿਤ ਇਲਜ਼ਾਮ ਲਗਾਏ ਗਏ: ਸੈਕਸ਼ਨ 13 (ਗ਼ੈਰਕਾਨੂੰਨੀ ਕਾਰਵਾਈਆਂ ਵਿਚ ਹਿੱਸਾ ਲੈਣਾ/ਉਸਦੀ ਹਮਾਇਤ ਕਰਨਾ/ਉਕਸਾਉਣਾ/ਉਸ ਨੂੰ ਅਮਲ ਵਿਚ ਲਿਆਉਣ ਲਈ ਭੜਕਾਉਣਾ), ਸੈਕਸ਼ਨ 18 (ਦਹਿਸ਼ਤਗਰਦ ਕਾਰਵਾਈ ਦੀ ਸਾਜ਼ਿਸ਼/ਕੋਸ਼ਿਸ਼ ਕਰਨਾ), ਸੈਕਸ਼ਨ 20 (ਇਕ ਦਹਿਸ਼ਤਗਰਦ ਗਰੋਹ ਜਾਂ ਜਥੇਬੰਦੀ ਦਾ ਮੈਂਬਰ ਹੋਣਾ), ਸੈਕਸ਼ਨ 38 (ਇਕ ਦਹਿਸ਼ਤਗਰਦ ਜਥੇਬੰਦੀ ਦੀਆਂ ਸਰਗਰਮੀਆਂ ਨੂੰ ਅੱਗੇ ਵਧਾਉਣ ਦੇ ਇਰਾਦੇ ਨਾਲ ਉਸ ਨਾਲ ਜੁੜਨਾ) ਅਤੇ ਸੈਕਸ਼ਨ 39 (ਇਕ ਦਹਿਸ਼ਤਗਰਦ ਜਥੇਬੰਦੀ ਦੀ ਹਮਾਇਤ ਵਧਾਉਣ ਦੇ ਮਕਸਦ ਨਾਲ ਮੀਟਿੰਗਾਂ ਕਰਨ 'ਚ ਮਦਦ ਕਰਨਾ ਜਾਂ ਉਨ੍ਹਾਂ ਨੂੰ ਸੰਬੋਧਨ ਕਰਨਾ)। ਉਸ ਉਪਰ ਇਲਜ਼ਾਮ ਲਗਾਇਆ ਗਿਆ ਕਿ ਉਸਨੇ ਸੀ.ਪੀ.ਆਈ.(ਮਾਓਵਾਦੀ) ਦੀ ਕਾ. ਨਰਮਦਾ ਨੂੰ ਦੇਣ ਲਈ, ਜੇ.ਐੱਨ.ਯੂ. ਦੇ ਇਕ ਵਿਦਿਆਰਥੀ ਹੇਮ ਮਿਸ਼ਰਾ ਨੂੰ ਇਕ ਕੰਪਿਊਟਰ ਚਿੱਪ ਦਿੱਤੀ ਸੀ। ਹੇਮ ਮਿਸ਼ਰਾ ਨੂੰ ਅਗਸਤ 2013 'ਚ ਬਲਾਰਸ਼ਾਹ ਰੇਲਵੇ ਸਟੇਸ਼ਨ ਤੋਂ ਗ੍ਰਿਫ਼ਤਾਰ ਕੀਤਾ ਗਿਆ ਅਤੇ ਉਹ ਡਾ. ਸਾਈਬਾਬਾ ਦੇ ਨਾਲ ਨਾਗਪੁਰ ਜੇਲ੍ਹ ਵਿਚ ਬੰਦ ਹੈ। ਇਸ 'ਸਾਜ਼ਿਸ਼' ਵਿਚ ਉਸ ਦੇ ਨਾਲ ਦੇ ਹੋਰ ਤਿੰਨ ਮੁਲਜ਼ਿਮ ਜ਼ਮਾਨਤ ਉਪਰ ਰਿਹਾਅ ਹੋ ਚੁੱਕੇ ਹਨ।ਦੋਸ਼-ਪੱਤਰ ਵਿਚ ਗਿਣਾਏ ਹੋਰ ਗੰਭੀਰ ਜੁਰਮ ਇਹ ਹਨ ਕਿ ਡਾ. ਸਾਈਬਾਬਾ ਰੈਵੋਲੂਸ਼ਨਰੀ ਡੈਮੋਕਰੇਟਿਕ ਫਰੰਟ ਦੇ ਜਾਇੰਟ ਸਕੱਤਰ ਹਨ। ਆਰ.ਡੀ.ਐੱਫ. ਉੜੀਸਾ ਅਤੇ ਆਂਧਰਾ ਪ੍ਰਦੇਸ਼ ਵਿਚ ਇਕ ਪਾਬੰਦੀਸ਼ੁਦਾ ਜਥੇਬੰਦੀ ਹੈ, ਉਥੇ ਇਸ ਉਪਰ ਮਾਓਵਾਦੀ 'ਫਰੰਟ' ਜਥੇਬੰਦੀ ਹੋਣ ਦਾ ਸ਼ੱਕ ਹੈ। ਨਾ ਇਹ ਦਿੱਲੀ ਵਿਚ ਪਾਬੰਦੀਸ਼ੁਦਾ ਹੈ, ਨਾ ਹੀ ਮਹਾਰਾਸ਼ਟਰ ਵਿਚ। ਇਸ ਦੇ ਪ੍ਰਧਾਨ ਜਾਣੇ-ਪਛਾਣੇ ਕਵੀ ਵਰਵਰਾ ਰਾਓ ਹਨ, ਜੋ ਹੈਦਰਾਬਾਦ ਵਿਚ ਰਹਿੰਦੇ ਹਨ।ਡਾ. ਸਾਈਬਾਬਾ ਦੇ ਮਾਮਲੇ ਦੀ ਸੁਣਵਾਈ ਅਜੇ ਸ਼ੁਰੂ ਨਹੀਂ ਹੋਈ। ਇਸ ਦੇ ਸ਼ੁਰੂ ਹੋਣ ਵਿਚ ਜੇ ਵਰ੍ਹੇ ਨਹੀਂ ਤਾਂ ਮਹੀਨੇ ਲੱਗਣ ਦੀ ਸੰਭਾਵਨਾ ਹੈ। ਸਵਾਲ ਇਹ ਹੈ ਕਿ 90ਫ਼ੀਸਦੀ ਅਪਾਹਜ ਬੰਦਾ ਜੇਲ੍ਹ ਦੇ ਉਨ੍ਹਾਂ ਬਹੁਤ ਹੀ ਭੈੜੇ ਹਾਲਾਤ ਵਿਚ ਕਦੋਂ ਤਕ ਜਿਊਂਦਾ ਰਹਿ ਸਕੇਗਾ?ਜੇਲ੍ਹ ਵਿਚ ਗੁਜ਼ਾਰੇ ਇਕ ਵਰ੍ਹੇ ਵਿਚ ਹੀ, ਉਸ ਦੀ ਸਿਹਤ ਖ਼ਤਰਨਾਕ ਰੂਪ 'ਚ ਵਿਗੜੀ ਹੈ। ਉਸ ਨੂੰ ਲਗਾਤਾਰ, ਤਕਲੀਫ਼ਦੇਹ ਦਰਦ ਹੁੰਦਾ ਰਹਿੰਦਾ ਹੈ। (ਜੇਲ ੍ਹ ਅਧਿਕਾਰੀਆਂ ਨੇ ਮਦਦਗਾਰ ਬਣਦੇ ਹੋਏ, ਇਸ ਨੂੰ ਪੋਲੀਓ ਪੀੜਤਾਂ ਲਈ 'ਬਹੁਤ ਹੀ ਮਾਮੂਲੀ' ਦੱਸਿਆ।) ਉਸਦੀ ਰੀੜ੍ਹ ਦੀ ਹੱਡੀ ਨਕਾਰਾ ਹੋ ਚੁੱਕੀ ਹੈ। ਇਹ ਟੇਢੀ ਹੋਕੇ ਫੇਫੜਿਆਂ ਵਿਚ ਧਸਦੀ ਜਾ ਰਹੀ ਹੈ। ਉਸਦੀ ਖੱਬੀ ਬਾਂਹ ਕੰਮ ਨਹੀਂ ਕਰ ਰਹੀ। ਜਿਸ ਮੁਕਾਮੀ ਹਸਪਤਾਲ ਵਿਚ ਅਧਿਕਾਰੀ ਉਸ ਨੂੰ ਮੁਆਇਨੇ ਲਈ ਲੈਕੇ ਗਏ ਸਨ, ਉਥੋਂ ਦੇ ਦਿਲ ਦੇ ਡਾਕਟਰ ਨੇ ਕਿਹਾ ਕਿ ਉਸਦੀ ਤੁਰੰਤ ਐਂਜੀਓਪਲਾਸਟੀ ਕਰਾਈ ਜਾਵੇ। ਜੇ ਉਸ ਦੀ ਐਂਜੀਓਪਲਾਸਟੀ ਹੁੰਦੀ ਹੈ ਤਾਂ ਉਸ ਦੀ ਅਜੋਕੀ ਹਾਲਤ ਤੇ ਜੇਲ੍ਹ ਦੇ ਹਾਲਾਤ ਨੂੰ ਦੇਖਦੇ ਹੋਏ ਇਹ ਇਲਾਜ ਜਾਨਲੇਵਾ ਹੀ ਸਾਬਤ ਹੋਵੇਗਾ। ਜੇਲ੍ਹ ਅਧਿਕਾਰੀਆਂ ਨੇ ਉਸ ਨੂੰ ਦਵਾਈਆਂ ਦੇਣ ਤੋਂ ਵਾਰ-ਵਾਰ ਇਨਕਾਰ ਕੀਤਾ ਹੈ, ਜੋ ਨਾ ਸਿਰਫ਼ ਉਸਦੀ ਤੰਦਰੁਸਤੀ ਲਈ ਸਗੋਂ ਉਸਦੀ ਜ਼ਿੰਦਗੀ ਲਈ ਬੇਹੱਦ ਜ਼ਰੂਰੀ ਹਨ। ਜਦੋਂ ਉਹ ਉਸ ਨੂੰ ਦਵਾਈਆਂ ਲੈਣ ਦੀ ਇਜ਼ਾਜਤ ਦਿੰਦੇ ਹਨ, ਓਦੋਂ ਵੀ ਉਹ ਉਸ ਨੂੰ ਵਿਸ਼ੇਸ਼ ਖਾਣਾ ਲੈਣ ਦੀ ਇਜ਼ਾਜਤ ਨਹੀਂ ਦਿੰਦੇ, ਜੋ ਉਨ੍ਹਾਂ ਦਵਾਈਆਂ ਦੇ ਨਾਲ ਦੇਣਾ ਜ਼ਰੂਰੀ ਹੁੰਦਾ ਹੈ।ਹਿੰਦੁਸਤਾਨ ਅਪਾਹਜਾਂ ਦੇ ਹੱਕਾਂ ਬਾਰੇ ਕੌਮਾਂਤਰੀ ਸਮਝੌਤੇ ਦਾ ਹਿੱਸਾ ਹੈ ਅਤੇ ਹਿੰਦੁਸਤਾਨੀ ਕਾਨੂੰਨ ਇਕ ਐਸੇ ਇਨਸਾਨ ਨੂੰ ਵਿਚਾਰ-ਅਧੀਨ ਕੈਦੀ ਵਜੋਂ ਲੰਮੇ ਸਮੇਂ ਲਈ ਕੈਦ ਰੱਖਣ ਦੀ ਸਾਫ਼ ਤੌਰ 'ਤੇ ਮਨਾਹੀ ਕਰਦਾ ਹੈ, ਜੋ ਅਪਾਹਜ ਹੈ, ਇਸ ਤੱਥ ਦੇ ਬਾਵਜੂਦ ਡਾ. ਸਾਈਬਾਬਾ ਨੂੰ ਹੇਠਲੀ ਅਦਾਲਤ ਵਲੋਂ ਦੋ ਵਾਰ ਜ਼ਮਾਨਤ ਦੇਣ ਤੋਂ ਨਾਂਹ ਕਰ ਦਿੱਤੀ ਗਈ। ਦੂਜੇ ਮੌਕੇ ਉਪਰ ਜ਼ਮਾਨਤ ਦੀ ਅਰਜੀ ਇਸ ਅਧਾਰ 'ਤੇ ਖਾਰਜ਼ ਕਰ ਦਿੱਤੀ ਗਈ ਕਿ ਜੇਲ੍ਹ ਅਧਿਕਾਰੀਆਂ ਨੇ ਅਦਾਲਤ ਦੇ ਸਾਹਮਣੇ ਇਹ ਦਿਖਾਇਆ ਸੀ ਕਿ ਉਨ੍ਹਾਂ ਵਲੋਂ ਉਸ ਨੂੰ ਜ਼ਰੂਰੀ ਤੇ ਖ਼ਾਸ ਦੇਖਭਾਲ ਮੁਹੱਈਆ ਕਰਵਾਈ ਜਾ ਰਹੀ ਹੈ, ਜੋ ਉਸ ਵਰਗੀ ਹਾਲਤ ਵਾਲੇ ਬੰਦੇ ਲਈ ਜ਼ਰੂਰੀ ਮੰਨੀ ਜਾਂਦੀ ਹੈ। (ਉਨ੍ਹਾਂ ਨੇ ਉਸਦੇ ਪਰਿਵਾਰ ਨੂੰ ਇਹ ਇਜ਼ਾਜਤ ਦਿੱਤੀ ਕਿ ਉਸਦੀ ਵੀਲ੍ਹ ਚੇਅਰ ਬਦਲ ਦੇਣ)। ਡਾ. ਸਾਈਬਾਬਾ ਨੇ ਜੇਲ੍ਹ ਵਿੱਚੋਂ ਲਿਖੇ ਇਕ ਖ਼ਤ ਵਿਚ ਕਿਹਾ ਕਿ ਜਿਸ ਦਿਨ ਜ਼ਮਾਨਤ ਦੇਣ ਤੋਂ ਨਾਂਹ ਕਰਨ ਦਾ ਫ਼ੈਸਲਾ ਆਇਆ, ਓਦੋਂ ਹੀ ਉਸਦੀ ਖ਼ਾਸ ਦੇਖਭਾਲ ਵਾਪਸ ਲੈ ਲਈ ਗਈ। ਨਿਰਾਸ਼ ਹੋ ਕੇ ਉਸ ਨੇ ਭੁੱਖ-ਹੜਤਾਲ ਸ਼ੁਰੂ ਕਰ ਦਿੱਤੀ। ਕੁਛ ਦਿਨਾਂ 'ਚ ਹੀ ਉਸ ਨੂੰ ਬੇਹੋਸ਼ੀ ਦੀ ਹਾਲਤ ਵਿਚ ਹਸਪਤਾਲ ਲਿਜਾਇਆ ਗਿਆ।ਬਹਿਸ ਦੀ ਖ਼ਾਤਰ, ਇਸ ਦੇ ਬਾਰੇ ਫ਼ੈਸਲਾ ਤਾਂ ਅਦਾਲਤ ਉਪਰ ਛੱਡ ਦਿੰਦੇ ਹਾਂ ਕਿ ਲਗਾਏ ਗਏ ਇਲਜ਼ਾਮਾਂ ਦੇ ਮਾਮਲੇ ਵਿਚ ਡਾ. ਸਾਈਬਾਬਾ ਕਸੂਰਵਾਰ ਹੈ ਜਾਂ ਨਹੀਂ। ਥੋੜ੍ਹੀ ਦੇਰ ਲਈ ਸਿਰਫ਼ ਜ਼ਮਾਨਤ ਦੇ ਸਵਾਲ ਉਪਰ ਗ਼ੌਰ ਕਰਦੇ ਹਾਂ, ਕਿਉਂਕਿ ਉਸਦੇ ਲਈ ਇਹ ਹਰਫ਼-ਬ-ਹਰਫ਼ ਜ਼ਿੰਦਗੀ-ਮੌਤ ਦਾ ਸਵਾਲ ਹੈ।ਉਸ ਉਪਰ ਲਗਾਏ ਇਲਜ਼ਾਮ ਕੁਛ ਵੀ ਹੋਣ, ਕੀ ਪ੍ਰੋਫੈਸਰ ਸਾਈਬਾਬਾ ਨੂੰ ਜ਼ਮਾਨਤ ਮਿਲਣੀ ਚਾਹੀਦੀ ਹੈ? ਇਥੇ ਉਨ੍ਹਾਂ ਮਸ਼ਹੂਰ ਜਨਤਕ ਸ਼ਖਸੀਅਤਾਂ ਅਤੇ ਸਰਕਾਰੀ ਮੁਲਾਜ਼ਮਾਂ ਦੀ ਇਕ ਸੂਚੀ ਪੇਸ਼ ਹੈ, ਜਿਨ੍ਹਾਂ ਨੂੰ ਜ਼ਮਾਨਤ ਦਿੱਤੀ ਗਈ ਹੈ।23 ਅਪ੍ਰੈਲ 2015 ਨੂੰ ਬਾਬੂ ਬਜਰੰਗੀ ਨੂੰ ਗੁਜਰਾਤ ਹਾਈ ਕੋਰਟ ਵਿਚ 'ਅੱਖ ਦੇ ਇਕ ਫੌਰੀ ਅਪਰੇਸ਼ਨ' ਦੇ ਲਈ ਜ਼ਮਾਨਤ ਉਪਰ ਰਿਹਾਅ ਕੀਤਾ ਗਿਆ, ਜੋ 2002 ਵਿਚ ਨਰੋਦਾ ਪਾਟਿਆ ਕਤਲੇਆਮ ਵਿਚ, ਆਪਣੀ ਭੂਮਿਕਾ ਕਾਰਨ ਕਸੂਰਵਾਰ ਸਾਬਤ ਹੋ ਚੁੱਕਾ ਹੈ ਜਿਥੇ ਦਿਨ-ਦਿਹਾੜੇ 97 ਲੋਕ ਮਾਰ ਦਿੱਤੇ ਗਏ ਸਨ, ਅਤੇ ਜਿਸ ਨੂੰ ਉਮਰ ਕੈਦ ਦੀ ਸਜ਼ਾ ਸੁਣਾਈ ਜਾ ਚੁੱਕੀ ਹੈ। ਇਹ ਉਹੀ ਬਾਬੂ ਬਜਰੰਗੀ ਹੈ, ਜਿਸ ਨੇ ਆਪਣੀ ਜ਼ਬਾਨੀ ਆਪਣੇ ਕੀਤੇ ਜੁਰਮ ਦੇ ਬਾਰੇ ਹੁੱਬਕੇ ਕਿਹਾ ਸੀ: 'ਅਸੀਂ ਮੁਸਲਮਾਨਾਂ ਦੀ ਇਕ ਵੀ ਦੁਕਾਨ ਨਹੀਂ ਛੱਡੀ। ਅਸੀਂ ਸਭ ਕਾਸੇ ਨੂੰ ਅੱਗ ਲਾ ਦਿੱਤੀ, ਅਸੀਂ ਉਨ੍ਹਾਂ ਨੂੰ ਜਲਾਇਆ ਅਤੇ ਮਾਰ ਮੁਕਾਇਆ। ਟੁਕੜੇ-ਟੁਕੜੇ ਕੀਤੇ, ਸਾੜਿਆ, ਅੱਗ ਲਾਈ੩.... ਅਸੀਂ ਉਨ੍ਹਾਂ ਨੂੰ ਅੱਗ ਲਗਾਉਣ ਵਿਚ ਵਿਸ਼ਵਾਸ ਰੱਖਦੇ ਹਾਂ ਕਿਉਂਕਿ ਉਹ ਹਰਾਮੀ ਚਿਤਾ ਉਪਰ ਸੜਨਾ ਨਹੀਂ ਚਾਹੁੰਦੇ। ਉਹ ਇਸ ਤੋਂ ਡਰਦੇ ਹਨ।' [ਆਫਟਰ ਕਿਲਿੰਗ ਦੈੱਮ ਆਈ ਫੈਲਟ ਲਾਈਕ ਮਹਾਰਾਣਾ ਪ੍ਰਤਾਪ', ਤਹਿਲਕਾ, 1 ਸਤੰਬਰ 2007]ਅੱਖ ਦਾ ਅਪਰੇਸ਼ਨ, ਵਾਹ? ਸ਼ਾਇਦ ਜ਼ਰਾ ਸੋਚੋ, ਇਹ ਇਕ ਫੌਰੀ ਲੋੜ ਹੈ ਕਿ ਉਹ ਜਿਨ੍ਹਾਂ ਕਾਤਲ ਅੱਖਾਂ ਨਾਲ ਦੁਨੀਆ ਨੂੰ ਦੇਖਦਾ ਹਾਂ, ਉਨ੍ਹਾਂ ਨੂੰ ਕੁਛ ਘੱਟ ਬੇਵਕੂਫ਼ ਅਤੇ ਕੁਛ ਘੱਟ ਖ਼ਤਰਨਾਕ ਅੱਖਾਂ ਵਿਚ ਬਦਲ ਦਿੱਤਾ ਜਾਵੇ।30 ਜੁਲਾਈ 2014 ਨੂੰ ਗੁਜਰਾਤ ਵਿਚ ਮੋਦੀ ਸਰਕਾਰ ਦੀ ਇਕ ਸਾਬਕਾ ਮੰਤਰੀ ਮਾਯਾ ਕੋਡਨਾਨੀ ਨੂੰ ਗੁਜਰਾਤ ਹਾਈ ਕੋਰਟ ਨੇ ਜ਼ਮਾਨਤ ਦੇ ਦਿੱਤੀ। ਜੋ ਉਸੇ ਨਰੋਦਾ ਪਾਟਿਆ ਕਤਲੇਆਮ ਵਿਚ ਕਸੂਰਵਾਰ ਸਾਬਤ ਹੋ ਚੁੱਕੀ ਹੈ ਅਤੇ 28 ਸਾਲ ਦੀ ਕੈਦ ਭੁਗਤ ਰਹੀ ਹੈ। ਕੋਡਨਾਨੀ ਇਕ ਮੈਡੀਕਲ ਡਾਕਟਰ ਹੈ ਜੋ ਕਹਿੰਦੀ ਹੈ ਕਿ ਉਸ ਨੂੰ ਅੰਤਾਂ ਦੀ ਤਪਦਿਕ ਹੈ, ਦਿਲ ਦਾ ਰੋਗ ਹੈ ਅਤੇ ਉਦਾਸੀ ਰੋਗ ਹੈ ਅਤੇ ਰੀੜ੍ਹ ਦੀ ਹੱਡੀ ਦੀ ਸਮੱਸਿਆ ਹੈ। ਉਸ ਦੀ ਸਜ਼ਾ ਵੀ ਮੁਲਤਵੀ ਕਰ ਦਿੱਤੀ ਗਈ ਹੈ।ਗੁਜਰਾਤ ਵਿਚ ਮੋਦੀ ਹਕੂਮਤ ਦੇ ਇਕ ਹੋਰ ਸਾਬਕਾ ਮੰਤਰੀ ਅਮਿਤ ਸ਼ਾਹ ਨੂੰ ਜੁਲਾਈ 2010 ਵਿਚ ਤਿੰਨ ਬੰਦਿਆਂ - ਸੋਹਰਾਬੂਦੀਨ ਸ਼ੇਖ, ਉਸਦੀ ਪਤਨੀ ਕੌਸਰ ਬੀ ਅਤੇ ਤੁਲਸੀਰਾਮ ਪਰਜਾਪਤੀ - ਦੇ ਗ਼ੈਰਅਦਾਲਤੀ ਕਤਲ ਦਾ ਆਦੇਸ਼ ਦੇਣ ਦੇ ਇਲਜ਼ਾਮ 'ਚ ਗ੍ਰਿਫ਼ਤਾਰ ਕੀਤਾ ਗਿਆ। ਸੀ.ਬੀ.ਆਈ. ਨੇ ਜੋ ਫ਼ੋਨ ਰਿਕਾਰਡ ਪੇਸ਼ ਕੀਤੇ ਉਹ ਦਿਖਾਉਂਦੇ ਸਨ ਕਿ ਸ਼ਾਹ ਦਾ ਉਨ੍ਹਾਂ ਪੁਲਿਸ ਅਧਿਕਾਰੀਆਂ ਨਾਲ ਲਗਾਤਾਰ ਰਾਬਤਾ ਸੀ ਜਿਨ੍ਹਾਂ ਨੇ ਉਨ੍ਹਾਂ ਨੂੰ ਮਾਰੇ ਜਾਣ ਤੋਂ ਪਹਿਲਾਂ ਗ਼ੈਰਕਾਨੂੰਨੀ ਹਿਰਾਸਤ ਵਿਚ ਲਿਆ ਸੀ। ਉਹ ਇਹ ਵੀ ਦਿਖਾਉਂਦੇ ਸਨ ਕਿ ਉਨ੍ਹਾਂ ਦਿਨਾਂ 'ਚ ਅਮਿਤ ਸ਼ਾਹ ਅਤੇ ਉਨ੍ਹਾਂ ਪੁਲਿਸ ਅਧਿਕਾਰੀਆਂ ਦੇ ਦਰਮਿਆਨ ਫ਼ੋਨ ਕਾਲਾਂ ਦੀ ਗਿਣਤੀ ਤੇਜ਼ੀ ਨਾਲ ਵਧ ਗਈ ਸੀ। (ਅੱਗੇ ਚਲਕੇ, ਪ੍ਰੇਸ਼ਾਨ ਕਰ ਦੇਣ ਵਾਲੀਆਂ ਅਤੇ ਰਹੱਸਮਈ ਘਟਨਾਵਾਂ ਦੇ ਇਕ ਸਿਲਸਿਲੇ ਤੋਂ ਬਾਦ, ਉਹ ਪੂਰੀ ਤਰ੍ਹਾਂ ਬਰੀ ਹੋ ਚੁੱਕਾ ਹੈ।) ਉਹ ਹੁਣ ਭਾਜਪਾ ਦਾ ਪ੍ਰਧਾਨ ਹੈ ਅਤੇ ਪ੍ਰਧਾਨ ਮੰਤਰੀ ਮੋਦੀ ਦਾ ਸੱਜਾ ਹੱਥ।22 ਮਈ 1987 ਨੂੰ ਹਾਸ਼ਿਮਪੁਰਾ ਤੋਂ ਪੁਲਿਸ ਆਰਮਡ ਕਾਂਸਟੈਬੂਲਰੀ (ਪੀ.ਏ.ਸੀ.) ਵਲੋਂ ਫੜ੍ਹਕੇ ਟਰੱਕ ਵਿਚ ਲਿਜਾਏ ਗਏ 42 ਮੁਸਲਮਾਨਾਂ ਨੂੰ ਗੋਲੀ ਮਾਰਕੇ ਉਨ੍ਹਾਂ ਦੀਆਂ ਲਾਸ਼ਾਂ ਥੋੜ੍ਹੀ ਦੂਰ, ਇਕ ਨਹਿਰ ਵਿਚ ਸੁੱਟ ਦਿੱਤੀਆਂ ਗਈਆਂ। ਇਸ ਮਾਮਲੇ ਵਿਚ ਪੀ.ਏ.ਸੀ. ਦੇ ਉੱਨੀ ਜਵਾਨ ਦੋਸ਼ੀ ਮੰਨੇ ਗਏ। ਉਨ੍ਹਾਂ ਵਿੱਚੋਂ ਸਾਰਿਆਂ ਦੀ ਨੌਕਰੀ ਬਰਕਰਾਰ ਰਹੀ, ਦੂਜਿਆਂ ਵਾਂਗ ਉਹ ਤਰੱਕੀਆਂ ਅਤੇ ਬੋਨਸ ਲੈਂਦੇ ਰਹੇ। ਤੇਰਾਂ ਸਾਲ ਬਾਦ, ਸੰਨ 2000 ਵਿਚ ਉਨ੍ਹਾਂ ਵਿੱਚੋਂ ਸੋਲਾਂ ਨੇ ਆਤਮ-ਸਮਰਪਣ ਕਰ ਦਿੱਤਾ (ਤਿੰਨ ਮਰ ਚੁੱਕੇ ਸਨ)। ਉਨ੍ਹਾਂ ਨੂੰ ਫੌਰੀ ਜ਼ਮਾਨਤ ਦੇ ਦਿੱਤੀ ਗਈ। ਕੁਛ ਹੀ ਹਫ਼ਤੇ ਪਹਿਲਾਂ, ਮਾਰਚ 2015 'ਚ ਸਾਰੇ ਸੋਲਾਂ ਜਵਾਨਾਂ ਨੂੰ ਸਬੂਤਾਂ ਦੀ ਅਣਹੋਂਦ 'ਚ ਰਿਹਾਅ ਕਰ ਦਿੱਤਾ ਗਿਆ।ਦਿੱਲੀ ਯੂਨੀਵਰਸਿਟੀ ਵਿਚ ਇਕ ਅਧਿਆਪਕ ਅਤੇ ਕਮੇਟੀ ਫਾਰ ਦ ਡਿਫੈਂਸ ਐਂਡ ਰਿਲੀਜ਼ ਆਫ ਸਾਈਬਾਬਾ ਦੇ ਇਕ ਮੈਂਬਰ ਹੈਨੀ ਬਾਬੂ ਹਾਲ ਹੀ ਵਿਚ ਕੁਛ ਮਿੰਟਾਂ ਲਈ ਹਸਪਤਾਲ ਵਿਚ ਡਾ. ਸਾਈਬਾਬਾ ਨੂੰ ਮਿਲਣ ਵਿਚ ਕਾਮਯਾਬ ਹੋ ਗਏ। 23 ਅਪ੍ਰੈਲ 2015 ਨੂੰ ਇਕ ਪ੍ਰੈੱਸ ਸੰਮੇਲਨ ਵਿਚ, ਜਿਸਦੀ ਕੋਈ ਖ਼ਬਰ ਹੀ ਨਹੀਂ ਛਪੀ, ਹੈਨੀ ਬਾਬੂ ਨੇ ਮੁਲਾਕਾਤ ਦੇ ਹਾਲਾਤ ਇੰਞ ਬਿਆਨ ਕੀਤੇ: ਡਾ. ਸਾਈਬਾਬਾ ਨੂੰ ਇਕ ਸੇਲਾਈਨ ਡ੍ਰਿਪ ਲਾਈ ਹੋਈ ਸੀ। ਉਹ ਬਿਸਤਰ ਤੋਂ ਉਠ ਕੇ ਬੈਠੇ ਅਤੇ ਉਸ ਨਾਲ ਗੱਲ ਕੀਤੀ। ਉਨ੍ਹਾਂ ਦੇ ਸਿਰ ਵੱਲ ਏਕੇ. ਸੰਤਾਲੀ ਤਾਣੀ ਇਕ ਸੁਰੱਖਿਆ ਮੁਲਾਜ਼ਮ ਖੜ੍ਹਾ ਰਿਹਾ। ਇਹ ਉਸਦੀ ਡਿਊਟੀ ਸੀ ਕਿ ਉਹ ਯਕੀਨੀਂ ਬਣਾਵੇ ਕਿ ਉਸਦਾ ਕੈਦੀ ਆਪਣੀਆਂ ਲਕਵਾਗ੍ਰਸਤ ਲੱਤਾਂ ਨਾਲ ਭੱਜ ਨਾ ਜਾਵੇ।ਕੀ ਡਾ. ਸਾਈਬਾਬਾ ਨਾਗਪੁਰ ਕੇਂਦਰੀ ਜੇਲ੍ਹ ਤੋਂ ਜ਼ਿੰਦਾ ਬਾਹਰ ਆ ਸਕੇਗਾ? ਕੀ ਉਹ ਚਾਹੁੰਦੇ ਹਨ ਕਿ ਸਾਈਬਾਬਾ ਬਾਹਰ ਆਵੇ? ਬਹੁਤ ਸਾਰੇ ਕਾਰਨ ਹਨ, ਜੋ ਇਸ਼ਾਰਾ ਕਰਦੇ ਹਨ ਕਿ ਉਹ ਐਸਾ ਨਹੀਂ ਚਾਹੁੰਦੇ।ਇਹੀ ਸਭ ਤਾਂ ਹੈ, ਜਿਸ ਨੂੰ ਅਸੀਂ ਬਰਦਾਸ਼ਤ ਕਰ ਰਹੇ ਹਾਂ, ਜਿਸ ਨੂੰ ਅਸੀਂ ਵੋਟ ਪਾਉਂਦੇ ਹਾਂ, ਜਿਸ ਨਾਲ ਅਸੀਂ ਰਜ਼ਾਮੰਦ ਹਾਂ।ਇਹੀ ਤਾਂ ਹਾਂ ਅਸੀਂ।

Why the Criminal Pursuit of Saibaba and Arundhati Roy is Bad in Law BY MARKANDEY KATJU ON 25/12/2015

The Nagpur bench of the Bombay High Court has cancelled the bail application of Delhi University lecturer G.N. Saibabaand issued a contempt of court notice to the author, Arundhati Roy for writing an article in Outlook magazine criticising the charges against him.
In my view, the court is wrong on both counts.
The case against Saibaba is that he had links with Maoist extremists. However, in Sri Indra Das vs. State of Assam, 2011. the Supreme Court observed that mere membership of a banned organisation (i.e. banned under the Unlawful Activities Prevention Act or TADA or any other statute) will not incriminate a person. The court referred to several decisions of the United States Supreme Court in this connection, which it followed.

In Scales v United States (1961), the US Supreme Court made a distinction between an active and a passive member of an organisation, and held that the latter could not be charged of a crime. In that decision Justice Harlan observed:
“The clause (in the McCarran Act, 1950) does not make criminal all associations with an organisation which has been shown to engage in illegal advocacy. There must be clear proof that a defendant ‘specifically intends to accomplish the aims of the organisation by resort to violence’. A person may be foolish, deluded, or perhaps merely optimistic, but he is not by this statute made a criminal.”
In Noto v United States (1961)Justice Harlan observed:
“… The mere teaching of Communist theory, including the teaching of the moral propriety or even moral necessity for a resort to force and violence, is not the same as preparing a group for violent action and steeling it to such action. There must be some substantial direct or circumstantial evidence of a call to violence now or in the future which is both sufficiently strong and sufficiently pervasive to lend colour to the otherwise ambiguous theoretical material regarding Communist Party teaching.”
Justice Hugo Black in a concurring judgment in the same case wrote:
“In 1799, the English Parliament passed a law outlawing certain named societies on the ground that they were engaged in ‘a traitorous conspiracy’ in conjunction with the persons from time to time exercising the powers of government in France.. One of the many strong arguments made by those who opposed the enactment of this law was stated by a member of that body, Mr. Tierney :
‘The remedy proposed goes to the putting an end to all these societies together. I object to the system, of which this is only a branch; for the Right Hon. gentleman has told us he intends to propose laws from time to time upon this subject, as cases may arise to require them. I say these attempts lead to consequences of the most horrible kind. I see that government are acting thus: those whom they cannot prove to be guilty, they will punish for their suspicion. To support this system, we must have a swarm of spies and informers. They are the very pillars of such a system of government.’
“The first banning of an association because it advocates hated ideas – whether that association be called a political party or not – marks a fateful moment in the history of a free country. That moment seems to have arrived for this country. This whole Act, with its pains and penalties, embarks this country, for the first time, on the dangerous adventure of outlawing groups that preach doctrines nearly all Americans detest. When the practice of outlawing parties and various public groups begins, no one can say where it will end. In most countries such a practice once begun ends with a one party government.”
In Joint Anti-Fascist Refugee Committee v. McGrath (1951), Justice Douglas in his concurring judgment observed: “In days of great tension when feelings run high, it is a temptation to take short cuts by borrowing from the totalitarian techniques of our opponents. But when we do, we set in motion a subversive influence of our own design that destroys us from within.”
In Yates v. United States (1957), Justice Harlan observed:
“In failing to distinguish between advocacy of forcible overthrow as an abstract doctrine and advocacy of action to that end, the District Court appears to have been led astray by the holding in Dennis that advocacy of violent action to be taken at some future time was enough. The District Court apparently thought that Dennis obliterated the traditional dividing line between advocacy of abstract doctrine and advocacy of action.”
In Brandenburg v. Ohio (1969), the US Supreme Court by a unanimous decision reversed its earlier decision in Whitney v. California (1927) and observed: “The Constitutional guarantees of free speech and free press do not permit a state to forbid or proscribe advocacy of the use of force or of law violation except where such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.”
In Whitney, Justice Brandeis, one of the most celebrated judges of the US Supreme Court had, in a concurring judgment which really reads like a dissent, observed:
“Fear of serious injury cannot alone justify suppression of free speech and assembly. Men feared witches and burned women. It is the function of free speech to free men from the bondage of irrational fears. To justify suppression of free speech there must be reasonable ground to fear that serious evil will result if free speech is practiced. There must be reasonable ground to believe that the danger apprehended is imminent… ….. The wide difference between advocacy and incitement, between preparation and attempt, between assembling and conspiracy, must be borne in mind.”
In the same judgment, Justice Brandeis went on to observe:
“Those who won our independence by revolution were not cowards. They did not fear political change. They did not exalt order at the cost of liberty. To courageous, self-reliant men, with confidence in the power of free and fearless reasoning applied through the processes of popular government, no danger flowing from speech can be deemed clear and present, unless the incidence of the evil apprehended is so imminent that it may befall before there is opportunity for full discussion. If there be time to expose through discussion the falsehood and fallacies, to avert the evil by the process of education, the remedy to be applied is more speech, not enforced silence.”
In Gitlow v. New York (1925) Justice Holmes (with whom Justice Brandeis joined) observed:
…”If what I think the correct test is applied, it is manifest that there was no present danger of an attempt to overthrow the government by force on the part of the admittedly small minority who shared the defendant’s views. It is said that this Manifesto was more than a theory, that it was an incitement. Every idea is an incitement. It offers itself for belief, and, if believed, it is acted on unless some other belief outweighs it, or some failure of energy stifles the movement at its birth. The only difference between the expression of an opinion and an incitement in the narrower sense is the speaker’s enthusiasm for the result. Eloquence may set fire to reason. But whatever may be thought of the redundant discourse before us, it had no chance of starting a present conflagration. If, in the long run, the beliefs expressed in proletarian dictatorship are destined to be accepted by the dominant forces of the community, the only meaning of free speech is that they should be given their chance and have their way.
“If the publication of this document had been laid as an attempt to induce an uprising against government at once, and not at some indefinite time in the future, it would have presented a different question. The object would have been one with which the law might deal, subject to the doubt whether there was any danger that the publication could produce any result; or, in other words, whether it was not futile and too remote from possible consequences. But the indictment alleges the publication and nothing more.”
In Terminiello v. Chicago (1949) Justice Douglas, speaking for the majority, observed:
“….A function of free speech under our system of government is to invite dispute. It may indeed best serve its high purpose when it induces a condition of unrest, creates dissatisfaction with conditions as they are, or even stirs people to anger. Speech is often provocative and challenging. It may strike at prejudices and preconceptions and have profound unsettling effects as it presses for acceptance of an idea. That is why freedom of speech, though not absolute,…is nevertheless protected against censorship or punishment, unless shown likely to produce a clear and present danger of a serious substantive evil that rises far above public inconvenience, annoyance or unrest….There is no room under our Constitution for a more restrictive view. For the alternative would lead to standardisation of ideas either by legislatures, courts, or dominant political or community groups.”
In DeJonge v. Oregon (1937) Chief Justice Hughes  wrote that the state could not punish a person making a lawful speech simply because the speech was sponsored by a subversive organisation. In Abrams v. US  (1919) Justice Holmes in his dissenting judgment wrote:
“Persecution for the expression of opinions seems to me perfectly logical. If you have no doubt of your premises or your power and want a certain result with all your heart you naturally express your wishes in law and sweep away all opposition. To allow opposition by speech seems to indicate that you think the speech impotent, as when a man says that he has squared the circle, or that you do not care whole-heartedly for the result, or that you doubt either your power or your premises. But when men have realized that time has upset many fighting faiths, they may come to believe even more then they believe the very foundations of their own conduct that the ultimate good desired is better reached by free trade in ideas, — that the best test of truth is the power of the thought to get itself accepted in the competition of the market; and that truth is the only ground upon which their wishes safely can be carried out. That, at any rate, is the theory of our Constitution. It is an experiment, as all life is an experiment. Every year, if not every day, we have to wager our salvation upon some prophecy based upon imperfect knowledge. While that experiment is part of our system I think that we should be eternally vigilant against attempts to check the expression of opinions that we loathe and believe to be fraught with death, unless they so imminently threaten immediate interference with the lawful and pressing purposes of the law that an immediate check is required to save the country. I wholly disagree with the argument of the government that the 1st Amendment left the common law as to seditious libel in force. History seems to me against the notion.”
Considering the above legal position, one fails to understand how a person who is 90% disabled, is permanently confined to a wheelchair, and was held in jail for 17 months in horrible conditions could be incriminated and charged as being an imminent threat to state security, and denied bail.
The case against Arundhati Roy
I have carefully perused the article of Arundhati Roy and I fail to see how it could be regarded as contempt of court in a democratic country and with a Constitution having freedom of speech as a guaranteed right vide Article 19(1)(a).
In a democracy, the purpose of the contempt power can only be to enable the court to function. The power is not to prevent the master (the people) from criticising the servant (the judge) if the latter does not function properly or commits misconduct.The basic principle in a democracy is that the people are supreme. It follows that all authorities – whether judges, legislators, ministers, or bureaucrats are servants of the people. Once this concept of popular sovereignty is kept firmly in mind, it becomes obvious that the people of India are the masters and all authorities (including the courts) are their servants.  It would logically follow that in a democracy the people have the right to criticise judges. Why then should there be a Contempt of Courts Act, which to some extent prevents people from criticising judges or doing other things that are regarded as contempt of court?
Article 19(1)(a) of the Constitution gives the right of freedom of speech and expression to all citizens. But Articles 129 and 215 give the power of contempt of court to the higher judiciary, and this power limits the freedom granted by Article 19(1)(a). How are these two provisions to be reconciled?
Once it is accepted that India is a democracy and that the people are supreme, reconciliation can only be effected by treating the right of the citizens to free speech and expression under Article 19(1)(a) to be primary, and the power of contempt to be subordinate. In other words, the people are free and have the right to criticise judges, but they should not go to the extent of making the functioning of the judiciary impossible or extremely difficult.
Hence, the true test to determine whether an act amounts to contempt of court or not is this: does it make the functioning of the judges impossible or extremely difficult? If it does not, then it does not amount to contempt of court even if it is harsh criticism
The view expressed above is, in fact, accepted now in England, the country from which India got its contempt law.
“Justice is not a cloistered virtue,” said Lord Atkin. “It must suffer the scrutiny and outspoken comments of ordinary men.”
As observed by Lord Salmon in AG vs. BBC (1981): “The description ‘Contempt of Court’ no doubt has a historical basis, but it is nonetheless misleading. Its object is not to protect the dignity of the courts but to protect the administration of justice.”
In R vs. Commissioner of Police (1968) Lord Denning observed: “Let me say at once that we will never use this jurisdiction as a means to uphold our own dignity. That must rest on surer foundations. Nor will we use it to suppress those who speak against us. We do not fear criticism, nor do we resent it. For there is something far more important at stake. It is no less than freedom of speech itself.”
Once a British newspaper ran a banner headline calling the majority judges of the House of Lords who decided the Spycatcher case (Attorney General vs. Guardian Newspaper (1987)) “YOU FOOLS”. Fali Nariman, who was present in England at that time, asked Lord Templeman, who was one of the majority, why the judges did not take contempt action. Lord Templeman smiled and said that judges in England took no notice of personal insults. Although he did not regard himself as a fool, others were entitled to their opinion.
In Balogh vs Crown Court at St Albans (1975), the defendant told the judge “You are a humourless automaton. Why don’t you self destruct?”. The judge smiled, but took no action.
The true test of contempt
The best shield and armour of a judge is his reputation of integrity, impartiality, and learning. An upright judge will hardly ever need to use the contempt power in his judicial career. I submit that the purpose of the contempt power is not to vindicate or uphold the majesty and dignity of the court (for it is automatically vindicated and upheld by the proper conduct of the judge, not by threats of using the contempt power) but only to enable the court to function. The contempt power should only be used in a rare and exceptional situation where, without using it, it becomes impossible or extremely difficult for the court to function. Even in such situations, the contempt power should not be used if a mere threat to use it suffices.
There may, of course, be differences of opinion about what acts prevent, or make very difficult, the functioning of a judge. For instance, do comments by the public (including lawyers, journalists, etc.), or publicity in the media about a pending case cause this? I think not. A judge should have the equanimity and inner strength to remain unperturbed and unruffled in any situation.
The expression ‘preventing or making it extremely difficult for the judge to function’ should ordinarily be understood with reference to a judge who has a true judge’s temperament – one that is detached, calm, with equanimity, and with broad enough shoulders to shrug off baseless criticism or attempts to influence him without being perturbed.
Contempt jurisdiction is now very sparingly exercised in these Western countries. Thus in Secretary of State for Defence v. Guardian Newspapers (1985), Lord Diplock observed that “the species of contempt which consists of ‘scandalising the judges’ is virtually obsolescent in England and may be ignored.”
Moreover, it must always be remembered that contempt jurisdiction is discretionary jurisdiction. A judge is not bound to take action for contempt even if contempt has, in fact, been committed.
Before concluding, I may refer to Judges by David Pannick in which he states:
“Some politicians, and a few jurists, urge that it is unwise or even dangerous to tell the truth about the judiciary. Judge Jerome Frank of the US Court of Appeals sensibly explained that he had little patience with, or respect for, that suggestion. He observed.” I am unable to conceive that, in a democracy, it can never be wise to acquaint the public with the truth about the workings of any branch of government. It is wholly undemocratic to treat the public as children who are unable to accept the inescapable shortcomings of man-made institutions.The best way to bring about the elimination of those shortcomings of our judicial system which are capable of being eliminated is to have all our citizens informed as to how that system now functions. It is a mistake, therefore, to try to establish and maintain, through ignorance, public esteem for our courts.”
In this connection, reference may be made to the amendment to the Contempt of Courts Act (the Contempt of Courts Amendment Act, 2006), which has introduced a new Section 13(b) that states: “The courts may permit, in any proceedings for contempt of court, justification by truth as a valid defence if it is satisfied that it is in public interest and the request for invoking the said defence is bona fide.”
Thus, truth is now a defence in contempt of court proceedings if it is in the public interest and is bona fide. This amendment is in the right direction, and was long overdue.
In sum, the notice issued  to Arundhati Roy is a reminder of the urgent need for India to adopt a fresh, modern, democratic approach to contempt jurisdiction. If England, the United States and the Commonwealth countries can do so without compromising the majesty of their courts, there is no justification for our judges to cling to the old anachronistic view.
